Developmental Standards Variance Approval
INTRODUCTION AND OVERVIEW
In the fall of 2000, an ADLS application and Development Plan were
approved for the development of this site located at the northeast corner of
126th Street and U.S. 31. Construction of that approved project did not
commence. Because the State of Indiana has begun the process of designing
the upgrade of U.S. 31, a revised development plan for the site is being
submitted to the Plan Commission for approval.
The overall project is planned to consist of three office buildings, to
be developed in three phases. The first phase consists of: a three story office
building containing 96,000 rentable square feet; the associated parking
areas and the construction of a retention pond.
The amended architectural design, landscaping, lighting and signage
(ADLS) for the first phase of this project, which is essentially the same as
the prior project, did not require a public hearing and was approved by the
Plan Commission Special Studies Committee on May 6, 2004.
Because of the anticipated right of way requirements of the State of
Indiana, the variance request from Section 23B.08.01(C) of the Carmel
Zoning Ordinance is to eliminate the build to line requirements for
buildings that front on U.S. Highway 31 and Pennsylvania Street. Instead,
the front building setback will be subject to the review and approval of the
City of Carmel Department of Community Services.

FINDINGS OF FACT - DEVELOPMENTAL STANDARDS VARIANCE
The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
the Department of Community Services will ensure that the front setbacks of the buildings will conform to the
approved development plan adopted by the Carmel Plan Commission.
The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
the vadance establishes the criteda and guidelines approved bv the Plan Commission in consideration of the use
and value of the adjacent area and orooerties.
The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the
use of the property because:
the State of Indiana's clans will cause a hardship to the applicant and its real estate and thereby creatinq a
practical difficulty in developinq the real estate that needs to be removed by this variance.
DECISION
IT IS THEREFORE the decision of the Hearing Officer of Carmel/Clay Board of Zoning Appeals that Developmental
Standards Variance, Docket No.04040020 V is granted, subject to any conditions stated in the minutes of the
Officer, which are incorporated herein by reference and made a part hereof.
