The outdoor fenced area depicted on the plans on file with the Department of Community Services ("DOCS") will only be used for the medical observation of animals. No animal will be allowed outside of the fenced medical observation area, unless being transported to its owner or by its owner offofthe Real Estate. No more than five (5) aniraals will be walked at a time within the medical observation area and if an animal within the medical observation area barks so that it may be audible to adjacent property owners, it will be muzzled until it is returned to the veterinarian office building. Binding on Successors & Assigns: This Commitment is binding on the Owner, each subsequent owner of the Real Estate and each other person acquiring an interest in the Real Estate, unless modified or terminated by the BZA. This Commitment may be modified or terminated only by a decision of the BZA made at a public hearing after notice has been provided pursuant to the rules of the BZA. 5. Effective Date.: This commitment shall become effective upon the approval by the BZA of the Variance of Use application filed under Docket No. 04040018 UV and the recordation of this document in the Office of the Recorder of Hamilton County, Indiana. 6. Recording: The undersigned authorize the Secretary of the BZA or the Director of DOCS to record these commitments in the Office of the Recorder of Hamilton County, Indiana. The grant of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The veterinarian office facility will be constructed to be compatible with adjacent land uses. The use or value of the area adjacent to the subject property will not be substantially affected in any adverse manner because: The veterinarian office facility will be constructed to be compatible with adiacent land uses.
