This letter serves to acknowledge receipt of a transmittal containing the construction plans for
the Village of West Clay, Section 10012. After reviev~g the plans, the Highway Department
has the following comments:
On page C106, please include a stop sign on the eastbound lane of Hourglass Drive to
stop for Bonaventure Avenue.
The issue of the curbs is the only other issue that remains unresolved. The Highway
Department, in reviewing the list of va~a _r~__~ that were o~ginally sought by the Brenwick
Corporation, has found no actions seeking the use of(we different curb types within the
development, It is the proposed policy of the Highway Department that all 'nee-
traditional' proposals use the chair back curb throughout the entire development.

Dear Mr. Andrick:
In response to Plan & Profile Sheet C-l, Page 15, where the proposed 12" force main
crosses Panhandle Eastern's 36", 24", and two 30" lfigh-pressure natural gas transmission
pipelines, the proposed right-of-way appears acceptable. Accurate pipeline elevations
need to be shown on the plan including the drip line tap valve at the pipelines.
For your review, enclosed is a copy of my letter dated 2-23-99, to Mr. Jose Kreutz~
Brenwick Development, which outlines criteria involving our facilities.
Please mark and stake the proposed crossing at our pipelines so our field representative
may probe for pipeline elevations and attempt to probe the 1 ½" drip line. Once
elevations are secured and forwarded to you, a new plan and profile sheet must be
submitted to this office for review and approval.

Dear Mr. Kreutz:
Enclosed is a copy of Panhandle Eastern Pipe Line Company's map showing the approximate
location of our 36", 24" and two 30" high pressure natural gas transmission pipelines.
We operate and maintain a strip of land being 50' Northwesterly of the most Northwesterly
pipeline extending over and across to 15' Southeasterly of the most Southeasterly pipeline. The
3-28-62 Right-of-Way Grant allows us the right for a 66' wide right,of-way for construction
purposes. We also maintain and operate a 1 ¼" drip line located within a 12' wide easement strip
as described in the attached Right-of-Way Grant.
In response to your facsimile letter dated 2-16-99, the drip line is active. Panhandles contractor
uses a vac truck to siphon the drip every 1 to 1 ¼ months. Relocating the drip line is not a
reasonable option since we must maintain our access to the drip line tap at the pipelines as well as
the tap at Clay Center Road.
Panhandle will not share the drip line easement for the proposed parallel sanitary sewer for Village
of West Clay. The proposed sewer may cross the pipelines at or near fight angles and maintain
clearances equal to the larger diameter of pipe but not less than 18". No foreign structures will be
permitted within the easement parcel. Sewer line must be installed under the pipelines and placed
so that no sealed joints are placed directly under the centerline of the pipelines.
Upon your surveyor staking the proposed crossing, pipeline elevations will be obtained. When
PEPL marks and locates the pipelines, they will also attempt to probe the drip line. The sewer
crossing the pipelines may require adjustments depending on the location and how the drip line is
connected to the pipelines. (200 & 300 lines).

EASEMENT RESTRICTIONS AND REQUIREMENTS
(l) No house, railroad track, garage, building, mobile home, house trailer, septic tank,
drain pipes, tree, shrub, berm, lake, reservoir, swimming pool or any other facility causing ~ither
the permanent or temporary retainment of water, or any other structure, facility or treelike growth
shall be placed, erected or planted anywhere on the EASEMENT PARCEL; provided, however,
that Grantor shall have the right to install or authorize the installation of utility installations on
said EASEMENT PARCEL so long as such utility installations are not placed parallel to
Grantee's said lines, and so long as such utility installations as may cross Grantee's said lines do so
under Grantee's said lines and at approximate right angles thereto and in such a manner as not to
interfere with, endanger or damage Grantee's said lines. Grantor shall give Grantee a minimum of
ninety (90) days written notice of the intended construction of any such facility and shall take such
steps to protect Grantee's said lines as Grantee may require. It is understood that Grantee has and
shall retain the right to remove, trim, defoliate or otherwise treat any trees or similar forms of
vegetation upon the EASEMENT PARCEL to the degree that same may be necessary in the
opinion of Grantee.
(2) No portion of the EASEMENT PARCEL shall be utilized for the seating or other
accommodation of persons in connection with any gathering of any sort, nor shall any portion of
the EASEMENT PARCEL be utilized for the parking of vehicles, and no impervious type
pavement in connection with the establishment or use of any vehicular parking area shall be placed
over or within the ]EASEMENT PARCEL.
(3) Grantor shall not remove any cover or overburden from Grantee's said lines, nor shall
any lateral or subjacent support be removed therefrom except temporarily and as an incident to
the cone'{ruction of utility installations herein above authorized to be placed across the
EASEMENT PARCEL or as an incident to the construction of any street, sidewalk, driveway,
road, ditch or swale, alley or cur§ing constructed on or off the EASEMENT PARCEL, and
Grantee shall, in no event, except upon the conditions hereinafter referred to in (4) below, be
required to alter or change the level or position of Grantee's said lines by reason of the exercise by
Grantor of any of the r~ights conferred on it with respect to the EASEMENT PARCEL_

(4) No street, sidewalk, fence, driveway, road, alley or curbing shall be constructed
substantially parallel to Grantees said lines and within the EASEMENT PARCEL. Nothing herein
shall preclude Grantor, its successors or assigns, from constructing any street, sidewalk, driveway,
road, fence, alley or curbing across Grantee's said lines so long as said street, sidewalk, fence,
driveway, road, alley or curbing shall cross Grantee's said lines at approximate right angles
thereto; provided, however, that if the proposed construction by Grantor, or its successors or
assigns, of any street, sidewalk, fence, driveway, road, alley or curbing across the EASEMENT
PARCEL would, in Grantee's opinion, imperil Grantee's said lines, then Grantor, and its
successors or assigns, may proceed with such proposed construction after (A) Grantor, or its'
successors or assigns, has entered into an agreement in form satisfactory to Grantee to pay to and
reimburse Grantee for all direct and indirect costs and expense of every sort and character which
would have to be incurred or expended by Grantee in connection with whatever protective work,
for example, lowering, encasing, adjusting or otherwise altering Grantee's said lines that might, in
Grantee's opinion, be required to protect Grantee's said lines from the consequences of such
proposed construction and (B) Grantee has had such reasonable period of time as might be
required by Grantee to complete such protective work as may be covered by the aforesaid ·
reimbursement agreement. In order to facilitate the proper operation of this provision, Grantor
shall give to Grantee a minimum of ninety (90) days notice, in writing, prior to the
commencement by itself or third parties of the types of construction referenced in this Paragraph,
and shall take such steps to protect Grantee's said lines as Grantee may require.
(5) It is recognized by the parties hereto that one purpose of this directive is to facilitate
the development by Grantor of lands covered by all Agreement(s) and Grants as originally
executed. Grantor hereby agrees that should its development of such lands in any way or for any
reason compel or make reasonably necessary the expenditure of additional funds by Grantee, such
shall be reimbursed to Grantee by Grantor. Such expenditures shall include, but not be limited to,
added expenditures for marking or protecting Grantee's lines made necessary by such change in
land. usage, whether such expenditures shall be demanded by governmental regulations or made
necessary, in Grantee's reasonable judgment, by the changed character and usage of the land.

RIGHT-OF-WAY AMENDMENT PROCEDURES
In order for Panhandle Eastern's legal department to prepare the
required amendatory agreement, it is necessary that you supply:
Evidence of present ownership in the form of a copy of
recorded instrument, such as Deed or Contract for
Purchase, etc..
2. The legal description of the property involved.
The full names of all parties orentities having
ownership interest.
Research and processing fee in the amount of $500.00,
paid in advance and non-refundable, by CERTIFIED CHECK
payable to Panhandle Eastern Pipe Line Company must
accompany the above referenced information. The fee
includes recordation of agreement.
A survey containing a legal description of the route of
the pipeline(s) and/or easement(s) across the property.
Upon receipt of the check, our field personnel will
locate and stake our pipeline(s). This must be done
when your licensed surveyor is present to eliminate
errors in surveying procedures, loss of stakes over the
pipeline(s), and to expedite your request. This
pipeline/easement description must be surveyed and
prepared by YOUR licensed surveyor and MUST include tie-
in measurements at the points where the
pipeline(s)/easement(s) enter and leave the property.
Failure to follow these requirements will only delay your
request. Your request must be made at least ninety (90) days in
advance of the date the requested document is needed or desired.

Per the instructions of the County Engineer, all subdivisions being proposed as "non-traditional" must be
constructed with chairback curbs. Therefore, please remove "roll curb" from the legend on this sheet and add
chairback with reverse slope. Also, please remove the letter 'A' from Hourglass Drive on Sheet C102.
Please insure that all ADA ramps do not conflict with storm inlets. It appears there maybe many conflicts at all
intersections.
Please make a note that saw cutting per INDOT specs will be required when connecting to the stub streets
from Section 10009.
What plans are being made to address underdrains which do not drain into a storm inlet? It has been our
departments standard to require street construction to end at an inlet or at a point in the vertical curvature
which promotes drainage toward a structure.
Please label the back to back widths and right of way widths for Bonaventure Avenue & Milford Street.
Please label the round-a-bout curb as chairback with reverse slope.
Please label the curb and centerline radii for the Clay Circle "ellipse"

On Sheets C201/C202/C203, please replace the 2' roll curb from the street legend with 2' chairback curb.
Also, please provide all horizontal curvature information from the centerline of the streets.

On Sheets C201/C202C203, it appears the sizes for the storm sewers on the profile views have been
mislabeled. Please verify that these diameters match the sizes shown on the site development plan.
5) Please provide a plan/profile view for Milford Street.

On Sheet C301, please include flow lines for all three details and provide spot elevations for the reverse slope
chair back curb along the Clay Circle round-a-bout. In addition, please show flow lines for the round-a-bout to
indicate that it will be superelevated.

On Sheets C401 & C405, please provide granular backfill (3 locations) where the 8" pvc sanitary sewer
crosses the right of way.
On Sheet C701/C702, please revise the street names for the street cross sections.
On Sheet C801, please remove details 1, 2, 3, 8, 9 & 10 since they are not authorized by the County Engineer
and they do not include the construction notes.
Please revise the typical street cross section to show a 28' back to back street width with 12' paved lanes. In
addition, please include a street cross section detail for Clay Circle showing the superelevation grade and street
width.
On Sheet C804, please remove standard details number C-1 and CS-1 and add S-4.
On Sheet C901, please make the following modifications:
a) Earthwork: Section 7 on Site Grading, please change the tolerance from 0.10 feet to 0.04 feet.
b) Streets: Section 3i, please state that all paving must comply with Section 401.05 of the 1NDOT
specifications book.
Eventually, a sheet named traffic control will need to be submitted within these construction plans detailing
where 20 MPH signs will be placed, stop signs, and yield signs. In addition, this sheet will need to show
locations of street name signs. However, our department asks that a Iayout for the entire subdivision be
provided on a 24" x 36" sheet so that the County Engineer can determine these locations. Please forward a copy
of this sheet to my attention for mark up.

The technical review and comments are intended to evaluate the completeness of the erosion and sediment control
plan for the project. The erosion and sediment control plan submitted was not reviewed for the adequacy of the
engineering'design. All practices included in the plan, as well as those recommended in the comments shouM be
evaluated as to their feasibility by a qualified individual with structural practices designed by a qualified engineer.
The plan has not been reviewezt for local, state or federal permits that may be required to proceed with this
project. Additional informatior~ including design calculations may be requested to further evaluate the erosion
sediment control plan.

Carmel Clay Schools appreciates notification of your submission for approval
of the above referenced sections for The Village of WestClay. The school
corporation has two areas of concern. In the interest of safety, the
installation of sidewalks should be mandated within the subdivision. In
addition, any cul-de-sacs should be a minimum of 93 feet to accommodate
the turning radius of an 84-passenger school bus.
Information regarding the development of new subdivisions is vital to the
process of accommodating the educational needs of a growing community.
The projected pupil growth from the subdivision has been anticipated in the
long.range plan for Carmel Clay Schools. Carmel Clay Schools fully intends
to provide a quality educational program for the patrons of The Village of
WestClay.

As a reminder, Indiana Public Law No. IS-69-1990, 2 working days before you dig, dial toll flee -
"Holey Moley", i-g00-382-5544. A Panhandle representative will properly locate and stake the
pipeline and must be present to monitor grading, construction, and excavation activity on or
adjacent the pipeline right-of-way
HOW TO RECOGNIZE A GAS LEAK
Gas leaks are uncommon, but it,s a good idea to know how to recognize them. Common signs
include:
* Agasodor ''
* Odor of gas where excavation work is in progress or has recently b'~en completed
· A blowing or hissing sound
· Dirt being blown or thrown into the air
· Water bubbling or being blown into the air at a pond, creek or river
* Fire coming from the ground or burning above the ground
· Brown patches in vegetation on or nea~ a fight-of-way
· Dry spot in a moist field
· Unusual noise or behavior oftbe flame at an appliance pilot or burner
· A fire in or near a gas appliance or piping
WHAT TO DO ABOUT A GAS LEAK
If you detect any signs of a gas leak outside, follow these steps:
· Leave area at once. Warn others to stay away.
Gas beifig lighter than air, stay on the upwind side.
· Avoid using ignition sources, such as cigarettes, matches, motor vehicles, telephones or
electric switches.
· Call appropriate gas company or 911 (or local emergency dispatch)
· If the situation warrants, call the local fire department
· Do not try to extinguish a gas fire or operate any pipeline valves.
