WARNING OF NONCOMPLIANCE
Dear Mr. Gibson
This office has been notified by John B. South, District Engineer for the Hamilton County Soil and Water
Conservation District that your project known as Emerald Crest is out of compliance with the National
Pollution Discharge Elimination System (NPDES) General Permit Rule 327 IAC 15-5.
It is the intent of the Division to resolve non-compliance issues and avoid referring this project to the Indiana
Department of Environmental Management (IDEM) for an enforcement action.
The On-Site Evaluations for this project document that little or no effort has been made to comply with the
conditions and requirements of 327 IAC 15-5. Copies of the most recent reports have been enclosed. The
reports clearly outline the deficiencies observed at the site and the requirements to bring the project back into
compliance.
Failure to implement and maintain appropriate erosion and sediment control measures is a serious violation
and deserves your immediate attention. It is therefore requested that on or before September 21, 2001 that
you adequately address the deficiencies as specified in the enclosed on-site evaluation. Once corrective
action has been taken to address the deficiencies, please notify John B. South, District Engineer.
Staff will continue to inspect this site to monitor progress and assess compliance with the Rule.
Failure to correct deficiencies will result in a referral to the Indiana Department of Environmental
Management and the initiation of an enfomement action.

In our previously submitted review letter, of primary importance are the following issues. (1) We will
need cooperation in working with the City on right-of-way needed and improvements planned for the
Pennsylvania Street Project, which will be providing access for this proposed site. (2) All curb cuts
and/or median cut(s) will require BPWS approval. The Engineering Department will need justification
fo~ the number of curb cuts requested. No curb cuts will be granted for 'future" development without
knowledge of the planned use. (3) In addition to the Hamilton County Surveyor's Office, the City of
Carmel will review/approve drainage for the site and will require copies of and verification of all permits
and approval given by the County.
3h. BUCKINGHAM COMPANIES
There is a small thangular portion at the southwestern comer of this development that has not been
annexed into the City. Annexation is required. We have only offered general comments tndate. We
reserve additional comments until such time that detailed construction plans and drainage calculations
are submitted for review. John Dully should be contacted to address any unresolved atility issues
4h. PLAT VACATION-BUCKINGHAM COMPANIES
We have not received information regarding this issue, so it would be inappropriate to comment.
7h. ASHBURY PARK
Engineering has initiated discussions with the developer regarding modifications that would allow for a
southern access off 131 Street. The developer's engineer is currently evaluating this pmpessl. There
is some concern that if no other access than onto 136~ Street or through Spring Farms is provided, it
may create additional "cut-through" traffic through an established neighborhood. While it has always
been a planned connection, a separate access to the south would help divert traffic wanting to head
south more directly to 131~ Street. This development has not been annexed. We reserve additional
comments until detailed construction plans have been submitted.

of Cherty Tree that are not to be affected by the vacation, the sidewalk should still be in.

Dear Mark:
Enclosed please find two copies of the revised primary plat,
construction plans for Section I and landscaping plans for Hazel Dell
Summit. Per the discussions at the last subcommittee review, we were
instructed to eliminate one lot from the section of lots backing onto
Cherry Tree Road, which would include Lots 1-14 and also eliminate the
street stub connection between Lots 11 and 12. These lots were then
widened to seventh-five feet in width to accommodate our largest
units. We still maintained a common area at the old right-of-way
location for a bike trail access to Cherry Tree; however, there will
be no street connection at this point.
Additionally, the landscape plans have been revised to increase
the size and quantity of materials along both Cherry Tree Avenue and
Main Street to provide a better buffering from the adjoining
properties. Additionally, the landscaping has been added to the
Cherry Tree Avenue buffer area in Section III. The landscape plan
also denotes the fencing proposed at this location. I have also
enclosed revised covenants restricting fencing to wrought iron.
Please review the plan and if you have any comments please call

At our last Subcommittee Meeting on May 5, 1999, we were
directed by the Committee to receive confirmation from the Parks
Board that the proposed park area at the north end of our site
would be a desirable area to be accepted by the Parks
Department. We immediately filed our request to Mr. Randy
Auler, of the Parks Department, who we have been working with on
this location for several years now.
This project was presented to the Parks Board at their next
available meeting, which was held on May 25, 1999. From this
meeting we did receive a favorable recommendation from the Board
that if the Hazel Dell Summit Plat were approved by the Plan
Commission that the Parks Board would consider this request for
a donation of park land at this location.
I want to inform you that 90% of the discussion regarding
this matter as presented to the Parks Board centered around
whether it was appropriate for the Parks Board to consider this
request prior to the Planning Commission approving the plat. As
we previously stated, the Parks Board has decided to take no
action on these matters until such time as the plats are
approved. They are very concerned with setting a precedence
where the Plan Commission will send all open space plans to them
for review prior to the approval of the plats. This appears to
be a major concern of the Board that they would like to avoid in
the future.

The Parks Board felt like they were sending the wrong
signal back to the Plan Commission by acting on our request even
though there was no major objections to the proposed park area.
I sincerely hope that in the future that the Plan Commission and
Parks Board agree on a procedure by which petitions of this
nature can have the input from the Parks Board without putting
the petitioner in the awkward position that we found ourselves
with this petition.
Also, as part of the donation of the land to the Parks
Department, we as petitioners, did agree to maintain the area by
keeping it mowed for a period of two years after the dedication.
We agreed to provide sanitary sewer access to the site for
restroom facilities and also agreed to donate a cash
contribution of $20,000 towards park improvements which could
include parking, shelters and other types of things deemed
necessary by the Parks Board. If this plat is approved, we
would proceed back to the Parks Department to work these items
out in more detail prior to them acting on this matter.
Hopefully, this satisfies the questions raised at the last
Subcommittee Meeting.
At the last Subcommittee Meeting questions were also raised
about the photographs we showed of the proposed homes to be
constructed by Davis. In particular, a question was raised
regarding one of the wider homes which showed a three car garage
and the capability of placing that particular home on lots in
this community, which are approximately five feet less in width
than the lots in Shelborne Orchard from which the photographs
were taken. The particular home in question is 59 feet in
width, while the majority of our homes range in the 45 to 55
foot wide range. There are numerous lots within our proposed
layout in Sections I and II which will provide additional width
for this wider home to be constructed. In fact, almost 10% of
the homes in this area will accommodate this particular home
with a third car garage. Additionally, other models of homes
that we have will accommodate a third car garage on about 25% of
the homes in this community.
Since our last Subcommittee Meeting there has also been
additional questions regarding the treatment of the perimeter of
the subdivision along Main Street and Cherry Tree Avenue. The
proposed treatment along 131Bt or Main Street will be identical
in nature to the wrought iron fencing, brick columns,
landscaping and mounding which exists along the frontage of The
Trails at Avian Glen directly to the west. I have enclosed
photographs of this area which would be extended along the
frontage of Main Street within the 50 foot buffer area, which is
provided in the plan. Also please note in the plan the units
abutting Main Street have been oriented such as the sides or
front of the homes are angled towards the street and not the
rear yard area. Additionally, the home sites will be at an
elevation lower than the street due to a natural topography of
the site, as you can see from some of the photographs taken of
this area. This elevation difference in conjunction with some
of the three to four feet mounding proposed in the fifty foot
buffer area will help with the buffering and view of these homes
from the street. We have also restricted the fencing within the
community to be black wrought iron only to match the fencing
proposed along the perimeter of the site.
I have also provided photographs of the existing mounding
and landscaping which exist along Cherry Tree Avenue. This will
also be extended along the area north of the creek.
Additionally, we have agreed to add twenty more evergreen trees
8' in height along the section of Cherry Tree south of the creek
to increase the buffer to the existing homes in Trails at Avian
Glen.
Regarding the concerns expressed by the adjoining Trails at
Avian Glen community we have had three additional meetings with
the homeowners since our last subcommittee. We have allowed
them to elect a new Board to replace Davis as the controlling
Board for the Association. We have had many discussions
regarding the Associations and providing separate Associations
and different possibilities of sharing in the use of the pool
facilities. We have hopefully reached an agreement whereby
Davis will release any rights to expanding the Association and
any rights to this proposed area utilizing the existing pool
facility in The Trails at Avian Glen. The newly elected Board
is reviewing our proposal and hopes to respond to us soon.
Additionally, at the last Subcommittee Meeting there was
discussion about other layouts on this site which might
incorporate open space in other portions of this site. I want
to reemphasize that our proposed plan is well below the
permitted density in this area of 2.1. Our present density is
1.8. The open space we have provided in our subdivision is 35%
and the required open space is 25%. We would be permitted by
existing ordinance to have twenty more lots on this site plan
and still comply with the ordinance, but we have elected not to
do so. Based on the layout of this site and what we feel is the
most attractive and useful open space area for this community is
to create a park area in the wooded portion of the site at the
north end of the community which is the primary conservation
area for our site. There are many other possible ways to lay
out this site as was mentioned by Mark Monroe at the last
meeting. This open space could have been distributed throughout
the site in many other ways, however, in our opinion the
proposed plan does meet the ordinance and does provide a nice
community park area which can be utilized by not only the
residences of this community but residences of all the
surrounding neighborhoods in the area. It provides a nice focal
point for the future Cherry Tree Avenue bike trail. This also
provides a very scenic view from Hazel Dell Road, which is the
primary roadway adjacent to our community.
The proposed open spaces provided throughout the rest of
the community along with the bike trail system proposed will
provide access for all the residents in this community with easy
access to not only the Common Areas along the creek but also to
the proposed park area at the north end of this section. Again,
we feel this is the most appropriate layout for the open space
for this particular community and would request your
consideration of our plan in its present state.

a donation of park land at this location.
I want to inform you that 90% of the discussion regarding
this ma~ter as presented =o =he Parks Board centered around
whether it was appropriate for the Parks Board to consider this
request prior to =he Planning Coa~ssion approving =he pla=. As
we previously stated, the Park~ Board has decided to take no
act/on on these matters until such time as the
approved. They are very concerned with setting a precedence
wher~ the Plan commission will send all open space plans to them
ior review prior =o the approval of the plats. This appears to
b~ a ma~or ¢oncerl~ of the Board that they would like ~o avoid in
the future.

At the last Subcomittee Meeting queations were also raised
about the photographs we showed o~ the proposed ho~es to be
constructed by Davis. In particular, a question was raise~
regardin~ one of the wider homes which showed a three car garage
and the capability of placing that partictllar home on lots in
thi~ co~lmunit¥, which are a~proxi~ately five feet less in width
than the lo~s in Shelborne Orch&rd from which the photographs
were taken. The Dar~icu/ar ho~e in question is 59 feet in
width, while the majority o~ our homes range in the %5 to $~
foot wi~ range. There are numerous lots within our proposed
layout in Sections ! and II which will provide additlonal width
~or this wider home to be constructed. In fact, almoat 10~ of
~he homes in this area will acco~moclat~ this particular home
with a third car garage. Additionally, other models o~ ho~es

Dear Mark:
We have been working with the Carmel Engineering office regarding
the access onto Hazel Dell Road for our Hazel Dell Summit project.
After several meetings we have agreed to relocate our entrance to the
north to align with the entrance to Delaware Trace. We have worked
closely with the Parks Department and Mayor's office regarding this
matter and it appears to be the best solution for all parties
concerned.
Due to the additional length of roadway required we have added
two additional lots along this new roadway so that the overall number
of lots in Section III of this development is 51 lots. Additionally,
the lots in this area have been enlarged to 80-feet in width.
Enclosed please find several copies of the revised primary plat
for this area. We will present this revision at the Planning
Commission Meeting on April 20th. Please review the revisions and if
you have any comments prior to the meeting please contact me at 595-
2903.
This revision will eliminate any additional immediate cuts to
Hazel Dell Road.

Dear Dick:
Enclosed please find a revised primary plat for Hazel Dell
Summit. We have made some of the revisions per your letter we
received at T.A.C. on March 17, 1999. The following is a
summary of the changes to the plan made in r6sponse to your
letter of March 17, 1999.
Item No. 1: We are continuing to work with the Engineer's
Office on the entrance location onto Hazel Dell Road. We will
meeting with the City Engineer Park's Department and Board of
Works to further review whether this entrance needs to be
relocated or not.
Item No. 2 & 3: Additional drainage calculations summaries
have been provided to your office to confirm the detention and
drainage calculations for this site. Additional drainage,
arrows, and designs have been added to the area adjacent to the
commercial area.
Item No. 4: The detention pond located on the southside of
the creek adjacent to Lot 114 will be located entirely out of
the floodplain area. There will be no additional fill required
between the pond and the floodplain. The pond on the northside
of the creek is partly located within the floodplain but outside
the limits of the floodway. There will be a small two-foot berm
located between the pond and the existing ditch. This berm will
be constructed of structural clay material so that we can avoid
any potential erosion problems during major storm events.

Additional information regarding the floodplain, floodway and drainage along
131"~ Street has been added to the plan. Additionally, detailed construction
plans have been submitted to your office for further review.
Per your comments at the T.A.C. Meeting and in your letter dated March
23, 1999, we have looked at the area along the Mitchener Ditch as it relates
to the lots abutting this area along the soutside of the creek.
Enclosed please find some photographs of the existing creek area along
the stretch of the site. As you can from these photograph~, this portion of
the creek is not wooded. There are a few trees and isolated areas along the
creek, however, a majority of the creek is very open and accessible to both
sides of the creek. The reason that our lots encroach fairly closely to the
creek at this location is an effort to save a tree llne in the center of the
site, which falls on the backside of the lots in this area. We feel that
most of the access for maintenance and clearing of this creek will be
provided along the northside of the creek where we intend to install an
asphalt bicycle-walking path along the edge of the creek between the pond and
the creekbank.
The slopes of this ditch are not excessive on either side of the creek
as you can see from the photographs. To help with the access we have
enlarged the easement behind Lots 107 to 111 to be approximately 30' in width
in lieu of 20' which will give further access if needed on this side. of the
creek. However, to move these lots from the back will jeopardize the tree

1. The proposed plan is based on the open space ordinan~. The Mitchner Drain that
flows through the site is thc most impotnant natural resource on the site. As such, it
deserves,more a~tention in the open space plan. A 50 feet wide riparian corridor on
both sides of the channel would be sufficient. This corridor would enhance the wildlife
value of the waterway and serve as a filter sWip for surface.wa~r pollutents. Suf~cient
room should be left on the north side of the channel for maintenance~ The steep slopes
on the south side prevent access. . .

This office Ires reviewed the preliminary plan for Hazel Dell Smmnit, wlfich was received on Jannary 29,
1999. We offer the following comments:
1. The Board of Public Works and Safety must approve median cuts on Hazel Dell Parkway. This office
would not support tnedian access at the location indicated on the plans. We believe the design should
be reevaluated to align this entrance with the existing Tammany Trail cntrance to Delaware Trace.
2. We are in the process of reviewing drainage calcs.
3. There is concern that not enough detention has been provided for the development south of the Vestel
Ditch. Also concerned how the area adjacent to the commercial development will drain.
4. We are also concerned that during periods of high atonn events (including 100 year), detention would
be sacrificed due to the apparent minimal distance between the ponds and the Vestel Ditch.
5. How steep are the benns between the ponds and file ditch?
Drawings need to indicate floodway delineation.
7. We request that all detention ponds be lined.
8. Will basements be allowed in this development?
9. Is the development north of the Vestel Ditch to be a part of Section 27
10. Eliminate curb inlets fi.om the radius of interseetion curves.
11. We would recommend "softening" file south entrance to lessen the slmrp right turn required to enter
the development from Cherry Tree Road.
12. Provide additional atmight pavement section prior to entering the curve on Emerald, north of the
intersection with Sapplfire in order to improve visibility and eliminate any skewed leg to the
intersection.
13. Acell/decel lanes are reqnired at allentrances.
14. Cannel Utilities will submit separate reviews for Water and Sanitary Sexvers.

A copy of the Mitchner Ditch Floodway Exhibit dated November 1, 1996. This exhibit
reflects revisions to the floodway I floodplain of Mitchner Ditch which was completed
as a part of the Trails of Avian Glen and the Bridge installation on Coopers Hawk
Drive, It has been accepted by IDNR as part of those approvals.
A copy of the Revised HEC-2 Study associated with the above exhibit and approvals
dated November 1996.
A copy of a Site Development Exhibit ( C202 ) on which the Floodway for Mitchner
Ditch has been shown. This also shows the existing 75' Legal Drain Easement and
the Proposed 30' ( south side of the ditch ) and 35' ( north side of the ditch ) Legal

Enclosed please find four copies of the revised primary
plat for Hazel Dell Summit. We have revised the plans in
accordance with your review letter dated February 23, 1999. The
comprehensive plan statement has been revised in accordance with
the 1996 plan. A copy of this statement is enclosed.
We are still waiting on the service reports from the
various public and private agencies needed for T.A.C. review.
We have been in contact with the surveyor and S.C.S. offices to
obtain their comments prior to the T.A.C. meeting. We have
requested also to be on the Board of Works Agenda for sanitary
sewer availability at their next available meeting. A&F
Engineering is preparing a traffic impact study for this site
and it will be forwarded to you in the next week to two weeks.
The plan has been revised to incorporate your items from
your letter, including the widening of the streets as you
requested on Emerald Pass, Olan Trail and Pima Pass. Several
street names have been amended and these are being forwarded to
the Communications Department for their review.
Details of the acceleration and deceleration lanes have
been added to the plans. The corner lots as they presently
exist on the plan are wider to accommodate the floor plans that
we would propose at this location. The flood plain for the
Mitchener Ditch has been labeled. The proposed pathway along

the northside of 131s~ Street has been revised to show it within
the 50-foot half right-of-way.
We have amended the trail linkage location to be between
Lots 10 and 11 at the northwest corner of Section Three. By
relocating it to this location, we can provide access to both
Cherry Tree Bike Trial and to the park area with one connection
point. This connection point is noted to be 10-feet wide and is
constructed such that it can be utilized to be used as an
emergency access for this area since these 49 lots have one
means of access.
Enclosed also please find several copies of the revised
landscaping plan. We have amended the .plant types as requested
and have also added landscaping along the rear lots of Cherry
Tree Avenue. Entry signage details have also been added to the
landscaping plan along with fencing details. There will be no
internal street lighting as we will require each home in the
community to have dusk to dawn yard or coach lights placed on
them. We are still waiting on water hydrant placement approval
from the Carmel Water Department and Fire Departments.

placed on the March 17th Technical Advisory Committee and the
April Planning Commission meeting. Please let us know the fee,
we will need to confirm a docket number.

The above referenced subdivision is coordinated with the Comprehensive Plan Update as follows:
Thoroughfare Plan:
The proposed project is anticipated to connect with Cherty Tree Road and Hazel Dell Pkwy.
Interior streets are anticipated to be 50' right-of-way with 30' streets with the exception of cul-de-sacs,
which shall have 26' street.
Land Use:
The Comprehensive Plan recommendation for Land Use in this area anticipates Medium Density
Residential (MDR) development. This is defined, per the Plan Update, as single-family residential
development at an average density of 1.3 to 3 units per gross acre. Further, it is intended to be suburban in
character and provide for infill of vacant developable sites with suitable supporting community facilities
and services.
The proposed project is 163 lots located on 88.30 acres, generating a density of 1.85 unit per
gross acre. Additionally, community services are either present currently or are adjacent to the proposed
site.
Schools:
Request for service report has been forwarded to Carmel/Clay Schools.
Parks & Recreation:
This proposed development is traversed by Mitchener Ditch, which has been recommended by
the Plan Uixlate as a potential Greenway. Presently, playfields and recreation opportunities exist at Cherry
Tree Elemontmy, the Administration Center, and at Badger Field located near the Southeast portion of
this prejeet.

Utility Report
Dear Mark:
The following is a summary of the proposcd utility considerations for the project
referred to above.
Sanitary Sewer: The proposed sanitary sewer system for the subdivision is intended to
provide gravity sewer service to each proposed lot. This will be accomplished by
connection of new onsite construction to the existing 12" Michener Ditch Sanitary Sewer
Interceptor at Cherry Tree Road.
New onsite sewers is 8" PVC designed and constructed in accordance with the
requirements of the State of Indiana and the City of Cannel. The average daily flow is
57,050 GPD. This is based upon 163 lots at 350 GPD/Iot. Waste treatment is to be
provided by the Cannel Wastewater Plant.
Water System: The proposed water system for this project will provide service to each
individual lot. Mains are located along the street fight of way providing the connection to
each lot.
Within the subdivision, 8" mains are to be internally looped, with 6" mains serving cul-de-
Fire hydrants and valving will be located throughout the subdivision consistent with the
requirements of the Carmel Utilities Department and the Fire Department.
Storm Sewer System: The proposed storm system for this subdivision will collect storm
water via beehive inlets, curb inlets, and manholes in the conventional fashion. The

stormwater is then routed through RCP pipe to detention facilities located onsite. This
detention facility is intended to provide discharge control to downstream areas, limiting
peak conditions for developed conditions under 1 O0 year storm runoff to rates established
for undeveloped 10 year storm runoff Discharge from this development will be to the
Michener Ditch.
The calculations, design, and construction of the storm sewer system will be in accordance
with the requirements of the Hamilton County Drainage Board.
Gas Service: It is anticipated that gas service will be available within this subdivision to be
provided by Indiana Gas.
Telephone Service: It is anticipated that phone service will be provided by Ameritech of
Indiana.
Electric Service: Cinergy PSI is anticipated to be the electric utility for this subdivision.

The proposed project is anticipated to connect with Cherry Tree Road and Hazel Dell Pkwy.
Interior streets are anticipated to be 50' right-of-way with 30' streets with the exception of cul-de-sacs,
wlffch slmll have 26' street.
Land Use:
The Comprebensive Plan recommendation for Laud Use in tiffs area anticipates Medium Density
Residential (MDR) development. Tiffs is defined, per Ihe Plan Update, as single-family residential
development at an average density of 2 to 4 units per gross acre. Funber, it is intended to be subnrban in
clmrncter and provide for infill of vacant developable sites with suitable supporting community facilities
and services.
Thc proposed project is 163 lots located on 88.30 acres, generating a density of 1.85 unit per
gross acre. Additionally, conmmnity services are either present cnrrenfly or are adjacent to the proposed
site.
Schools:
Request for service report has been forwarded to Carmel/Clay Schools.
Parks & Recreation:
This proposed developmoat is traversed by Milchener Dileb, which has bccn recommcuded by
the Plan Update ns a potcntiai Grecnway. Presently, playfields and recreation opportunities cxis~ at Chon3'
Trce Elementary, tim Administration Cenlcr, and at Badger Field located near the Southeast perlion of
this project.

The following agreement shall be considered pert of the plat application for Ihe project referred to above:
The developer shall be responsible for any drainage probleras including standing water, flooding, and
erosion control, which aris~ or become evident at any time during the three yeer nmintcnance period after
release of subdivision improvement bonds, and which is attributable to a deficiency in the subdivision
drainage design or ~e initial construction of fl~ drainage improvements. This shall include all pipes,
structures, swales, ditches, and ponds which are pertinent features to tbe property drainage of the
subdivision.
The responsibility of the developer hereunder shall not, bewcver, include problems which arc creeled
subscquenl to the completion by the developer of the subdivision improvements, including problems
resulting froln the improper grading by individual builders or structures or improper grading installed or
accomplished by individual homeowners or their agents.
It is the intent of this requirengnt that thc developer shall, specifically, provide such subsurface drains or
storm sewers or ditches as are required to properly rectify any drainage problem or subsurface water
problem which was not contemplated in tl~e original approved subdivision design, including dispesal of

Dear Mark & Mike:
We are proceeding with finalizing plans for the proposed
open space subdivision which we intend to file an application on
located east of Cherry Tree Avenue, west of Hazel Dell Road and
north of 131B~ Street. I have tried to review the open space
standards as outlined in the newly adopted open space ordinance
as it relates to the open space for this subdivision. I have
prepared and completed the open space schedule which is
enclosed.
I would appreciate your feedback as to the open space areas
complying with the new ordinance and my allocation of these open
spaces into the different categories outlined in the open space
schedule. I have highlighted the open space areas on the
attached plan for your review.
Please review the open space areas and contact me at 595-
2903 so that we may arrange a time to further review the
compliance with this plan to the open space standards in the new
ordinance.
