Introduction and Overview
The Brighton Woods Subdivision is located just northeast of the intersection of 116th
Street and Hazel Dell Parkway. When complete, the subdMsion will contain 38 homes - 17 of
which are located on the subdivision's eastern boundary adjacent to the Northwood Hills
Subdivision.
The homeowners and developer of Brighton Woods desire to have a privacy fence
installed between Brighton Woods and Northwood Hills that will provide the needed privacy for
both neighborhoods. The fence has been installed in the rear of eight homes that are occupied by
residents of Brighton Woods. The fence is allowed to be a maYimttm of six feet in height. By
mistake, the fence was installed on the eight occupied lots at eight feet without a variance.
This variance will allow the fence to be eight feet in height along all of the 17 lots on
Brighton Wood's eastern boundary. The top two feet of the fence have been designed with lattice
to accent the six foot wood slats. The fence has also been designed to have the same design and
quality of materials on both sides of the fence.
The eight foot fence, as shown in the enclosed photographs, will provide the necessary
privacy for both the residents of Brighton Woods and Northwood Hills.

FINDINGS OF FACT - DEVELOPMENTAL STANDARDS VARIANCE
The approval of this variance wfll not be injurious to the public health, safe{y, morals and general welfare of the
community because:
the maximum hei,qht established by this variance will have no effect on the commune.
The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
the vadance will increase the use and value of the area because property owners on both sides of the fence will
have qreater privacy.
The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the
use of the property because:
the six-foot fence will lower the homeowner's level of privacy and therefore will diminish the attractiveness of th~.
homes to its potential owner. Because the property is zoned S-1 it will be difficult to fully use the property to its
proposed use unless the variance is qranted.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Developmental Standards Vadance
Docket No. 04050049 V is granted, subject to any conditions stated in the minutes of this
Board, which are incorporated herein by reference and made a part hereof,
