Have you been to the site? The side and rear is where the changes are proposed (building addition, pavement, access to alley, etc.). The site is now 1/3 asphalt/concrete/building, 1/3 gravel (not approved) and 1/3 parking on grass (not approved). If you have not been to the site please visit the City of Carmel website and you can see the 2003 ortho photography. What do you mean by "will not be modified"? As for this instance I am sure that Dan Matthews (with your assistance) was treated fairly by the County when right-of-way was acquired. Is it your position that the right-of-way take requires Dan to double the size of his building and intensity of the operation? The proposal is for seven bays, right. I am just checking, you brought it up. Do not blame the County on your clients apparent desire not to follow the rules everyone else has to abide by. The ordinance standards regarding landscaping, lighting, curbing and drainage are appropriate to follow when businesses expand. If your client wants to discuss the options to modify the building brought on solely by condemnation we should set a meeting where we can discuss that type of proposal. No drainage report has been submitted either. This does not allow the necessary agencies to conduct review of the proposal. I was e-mailed an electronic copy of a site plan and elevations. That is not sufficient. When you filed the "many" variances no plans were submitted. We changed the filing for you to a blanket variance from all the overlay requirements. Based on the site plan and the B-2 zoning variances will be need from the landscape requirements of Chapter 26 and possibly the maximum lot coverage of 90%. The site plan also shows pavement all across the alley. Access (a drive connection) to the alley is permitted but not in the manner proposed. ADLS is a requirement of the B-2 zone. No application has been filed to date. No signage, lighting or landscaping information has been submitted for review. You are aware that the Plan Commission reviews the site proposal prior to the Board of Zoning Appeals acting on Variance requests. What is it that you want the Board and Plan Commission to review? I am not going to put you in front of the BZA because you have not submitted enough information to conduct an appropriate level of review. Are there any restrictions to something like this? I would like to let you know some of the concerns I have regarding the placement at that location. The most serious issue is that of ADA access to the main entrance to the building, which is on the north side. With the drive located to the north there is not enough room for an appropriate access ramp to the front door, and the fact that to get to the front door from the parking area a person would have to travel in the drive isn't the safest route.
