As a result of comments made during the public hearing for High Grove last week, I
thought I would address four items as they relate to the proposed project:

Other than remarks made during the Technical Advisory Committee meeting, we
have not received any additional correspondence from the Surveyors office. As
you can see, all of the TAC comments made have been addressed.

With respect to the placement improvements within the pipeline easement, it has
been the assertion of Panhandle Eastern Pipeline that no improvements be
placed on the easement, including: trees, evergreens, shrubs, fences, decks,
ponds, berms, structures, hydrants, signs, poles, and, no streets, walk, drives,
etc.., can be constructed substantially parallel to the pipelines. I have attached a
copy of Panhandle's letter dated March 15, 1999 regarding the easement for your
reference.
We have looked at the plausibility of relocating the entrance Northward but have
not yet found a creditable reason. In fact, a move greater than 150' puts the
entrance tapers within Panhandle's easement area. A relocation of the entrance
further North could also require a crossing the pipelines and Clay Creek with a
street, utilities, etc, adding construction and maintenance costs to the project.

fees for a Primary Plat Review paid, before any approvals will be granted from this office.
I have enclosed a blank form for your use.
Please label the 5 separate common areas as such.
The dimensions for the accel/decel lanes at the entrance should shown and labeled as
the following: *accel taper 100' in length
*deceltaper 100' in length
*decel lane 150' in length x 12' in width
In order to provide community connectivity, the Highway Department requires that a stub
street be provided to connect to the property to the south.
Please correct the horizontal curve radius which are less than the minimum 150'. Three
of the six curves shown on the plat are less that 150'.
The lengths of the cul-de-sacs appear to be less than the 600' allowable maximum.
Please verify that all of the cul-de-sacs are less that 600' in length.
Please note that no trees, sprinkler systems, signs or other such amenities are permitted
in the right of way.
Please label the right of way along the east side of Hoover Road as such. A triangular
right of way cut will need to be provided at the intersection of Hoover Road and the
entrance to Hoover Heights. The cut will need to have two 30' legs.
Please provide a 2' non-access easement along the east side of Hoover Road.

As you are aware, whenever a Developer proposes a new subdivision within the County,
the Highway Department expects the Developer to participate in improving nearby roads
and/or small structures around the subdivision which will be directly affected by the new
subdivision residents. Typical improvements include widening roads to current County
specifications, deep patching when necessary, wedging and resurfacing the road,
installing three foot stone shoulders and repairing or replacing small structures.
Currently, the Highway Department is investigating these improvements and will contact
Estridge Development once they have been determined. Please be aware that this will
need to be resolved before the Highway Department will approve the plans for Hoover
Heights.

pond to be placed in a significant drainage channel. The fnture residents will have high
maintenance costs because of sedimentation, trash, and high volumes of water
pollutants. Clay Creek should flow uninterrupted through the site. The soils may not be
suitable for a pond.

Enclosed is a copy of Panhandle Eastem's map showin~ the approximate location of our 36", 24",
and two 30" high-pressure natural gas transmission pipelines across the above referenced
property.
From the description you provided, Panhandle has an "open easement" across the property. If the
easement parcel were amended, we would require a strip of land being 50' NW of the most
northwesterly pipeline over and across to 50' SE of the most southeasterly pipeline. The attached
sheet describes easement restrictions and requirements, as well as procedure to have the easement
amended.
The requirements listed below are to assist in the planning of proposed development.
1. No permanent structures of any kind shall be permitted, placed or erected within the easement
area, including storm drain, catch basins, water impoundments, fire hydrants, sign boards,
supports, brace poles, telephone and power line poles.
2. All roads, driveways, storm drains and utilities ~all cross the pipeline at near or right angles
extending the width of the easement parcel Road crossings must cross at right angles and
have a minimum cover of 36" between the top of the pipeline and bottom of the pavement
extending the width of the easement parcel. Proposed street intersections and cul de sac
shall be designed outside the easement parcel All utilities shall be constructed below the
pipelines with a minimum clearance equal to the diameter of the larger utility, whichever is
greater, but not less than 18". The storm drain must be solid, hrq~ervious material extending
the width of the easement parcel. No foreign structures, appurtenances or related fittings
will be permitted within the easement parcel.
3. Telephone, electric, and plastic gas lines under 4" shall be installed under the pipeline, where
practical, and encased in conduit.
4. No trees, evergreens, shrubs shall be permitted, placed or planted anywhere on the easement
parcel.
5. Proposed ditches must have a minimum cover of 36" between the top of pipeline and bottom
o f ditch.
6. Any and all costs incurred as a result of alterations, upgrading of facilities or relocation that
are necessary on or adjacent to Panhandle's pipeline, or related facilities to accommodate
futm'e construction, will be reimbursed by the developer or person(s) to Panhandle.
The pipeline depth and location must be incorporated into the proposed development site plan and
accurately sealed onto your actual construction prints. All construction prints must contain the
following on each sheet showing the pipeline:
Danger.* Use Excessive Caution.* Panhandle Eastern Pipe Line Company high-
pressure natural gas pipelines. Panhandle must be notified (directly at 317/873-2410
and through the One-Call Center at 1-800-382-5544) two (2) full working days in
advance of any activity within its easement and have a representative present during
any excavation over or adjacent to its pipelines.
We would request copies of the preliminary plan prior to application with the city to avoid or cause
delay in development planning. Panhandle must pre-approve all planned construction and any

EASE~T~T RESTRICTIONS AND REQUIREMENTS
(I) No house, railroad track, garage, building, mobile homo, house trailer, septic tank,
drain pipes, tree, shrub, berm, lake, reservoir, swimming pool, deck, fence, or any other facility
causing either the permanent or temporary retainmem of water, or any other structure, facility or
treelike growth shall be placed, erected or planted anywhere on the EASEMENT PARCEL;
provided, however, that Grantor shall have the right to install or authorize the installation of
utility installations on said EASEMENT PARCEL so long as such utility installations are not
placed parallel to Grantee's said lines, and so long as such utility installations as may cross
Grantee's said lines do so under Grantee's said lines and at approximate right angles thereto and in
such a manner as not to interfere with, endanger or damage Grantee's said lines. Grantor shall
give Grantee a minimum of ninety (90) days written notice of the intended construction of any
such facility and shall take such steps to protect Grantee's said lines as Grantee may require. It is
understood that Grantee has and shall retain the right to remove, trim, defoliate or otherwise treat
any trees or s'nnilar forms of vegetation upon the EASEMENT PARCEL to the degree that same
may be necessary in the opinion of Grantee.
(2) No portion of the EASEMENT PARCEL shall be utilized for the seating or other
accommodation of persons in connection with any gathering of any sort, nor shall any portion of
the EASEMENT PARCEL be utilized for the parking of vehicles, and no impervious type
pavement in connection with the establishment or use of any vehicular parking area shall be placed
over or within the EASEMENT PARCEL.
(3) Grantor shall not remove any cover or overburden from Grantee's said lines, nor shall
any lateral or subjacent support be removed therefrom except temporarily and as an incident to
the construction of utility installations herein above authorized to be placed across the
EASEMENT PARCEL or as an incident to the construction of any street, sidewalk, driveway,
mad, ditch or swale, alley or curbing constructed on or off the EASEMENT PARCEL, and
Grantee shall, in no event, except upon the conditions hereinatter referred to in (4) below, be
required to alter or change the level or position of Grantee's said lines by reason of the exercise by
Grantor of any of the rights conferred on it with respect to the EASEMENT PARCEL.

(4) No street, sidewalk, driveway, road, alley or curbing shall be constructed substantially
parallel to Grantees said lines and within the EASEMENT PARCEL. Nothing herein shall
preclude Grantor, its successors or assigns, from constructing any street, sidewalk, driveway,
road, alley or curbing across Grantee's said lines so long as said street, sidewalk, driveway, road,
alley or curbing shall cross Grantee's said lines at approximate right angles thereto; provided,
however, that if the proposed construction by Grantor, or its successors or assigns, of any street,
sidewalk, driveway, road, alley or curbing across the EASEMENT PARCEL would, in Grantee's
opinion, imperil Grantee's said lines, then Grantor, and its successors or assigns, may proceed
with such proposed construction after (A) Grantor, or its' successors or assign% has entered into
an agreement in form satisfactory to Grantee to pay to and reimburse Grantee for all direct and
indirect costs and expense of every sort and character which would have to be incurred or
expended by Grantee in connection with whatever protective work, for example, lowering,
encasing, adjusting or otherwise altering Grantee's said lines that might, in Grantee's opinion, be
required to protect Grantee's said lines from the eoesequenees of such proposed construction and
(B) Grantee has had such reasonable period of time as might be required by Grantee to complete
such protective work as may be covered by the aforesaid reimbursement agreement. In order to
facilitate the proper operation of this provision, Grantor shall give to Grantee a minimum of ninety
(90) days notice, in writing, prior to the commencement by itself or third parties of the types of
construction referenced in this Paragraph, and shall take such steps to protect Grantee's said lines
as Grantee may require.
(5) It is recognized by the parties hereto that one purpose of this directive is to facilitate
the development by Grantor of lands covered by all Agreement(s) and Grants as originally
executed. Grantor hereby agrees that should its development of such lands in any way or for any
reason compel or make reasonably necessary the expenditure of additional funds by Grantee, such
shall be reimbursed to Grantee by Grantor. Such expenditures shall include, but not be limited to,
added expenditures for marking or protecting Grantee's lines made necessary by such change in
land usage, whether such expenditures shall be demanded by governmental regulations or made
necessary, in Grantee's reasonable judgment, by the changed character and usage of the land.

In order for Panhandle Eastern's legal department to prepare the
required amendatory agreement, it is necessary that you supply:
Evidence of present ownership in the form of a copy of
recorded instrument, such as Deed or Contract for
Purchase, etc..
2. The legal description of the property involved.
3. The full names of all parties or entities having
ownership interest.
Research and processing fee in the amount of $500.00,
paid in advance and non-refundable, by CERTIFIED CHECK
payable to Panhandle Eastern Pipe Line Company must
accompany the above referenced information. The fee
includes recordation of agreement.
A survey containing a legal description of the route of
the pipeline(s) and/or easement(s) across the property.
Upon receipt of the check, our field personnel will
locate and stake our pipeline(s). This must be done
when your licensed surveyor is present to eliminate
errors in surveying procedures, loss of stakes over the
pipeline(s), and to expedite your request. This
pipeline/easement description must be surveyed and
prepared by YOUR licensed surveyor and MUST include tie-
in measurements at the points where the
pipeline(s)/easement(s) enter and leave the property.
Failure to follow these requirements will only delay your
request. Your request must be made at least ninety (90) days in
advance of the date the requested document is needed or desired.

HOW TO RECOGNIZE A GAS LEAK
Gas leaks are uncommon, but itls a good idea to know how to recogrlize them. Common signs
include:
* A gas odor ' '
* Odor of gas where excavation work is in progress or has recently b'~en completed
· A blowing or hissing sound
· Dirt being blown or tM'own into the air
· Water bubbling or being blown into the air at a pond, creek or river
o Fire coming from the ground or burning above the ground
· Brown patches in vegetation on or near a right-of-way
· Dry spot in a moist field
· Unusual noise or behavior of the flame at an appliance pilot or burner
· A fire in or near a gas appliance or piping
WHAT TO DO ABOUT A GAS LEAK
If you detect any signs ora gas leak outside, follow these steps:
* Leave area at once. Warn others to stay away.
Gas being lighter than air, stay on the upwind side.
* Avoid using ignition sources, such as cigarettes, matches, motor vehicles, telephones or
electric switches.
· Call appropriate gas company or 911 (or local emergency dispatch)
· If the situation warrants, call the local fire department
· Do not try to extinguish a gas fire or operate any pipeline valves.

1. Show drainage improvements for Hoover Road.
2. The existing pond has been leaking. The water level drops to the ditch level. An
inspection and recommendations should be made for construction plans.
3. The loop road requires gutter flow through the intersections, a condition we try to
avoid.
4. The proposed pond is situated in Clay Creek. This is a poor location for a small
pond to be placed in a significant drainage channel The furore resident~ will have high
maintenance costs bemuse of sedimentation, trash, and high volumes of water
pollutants~ Clay Creek should flow uninterrupted through the site. The soils may not be
suitable for a pond.

As you am aware, whenever a Developer proposes a new subdivision within the County,
the Highway Department expects the Developer to participate in improving nearby roads
and/or small structures around the subdivision which will be directly affected by the new
subdivision residents. Typical improvements include widening roads to current County
specifications, deep patching when necessary, wedging and resurfacing the road,
installing three foot stone shoulders and repairing or replacing small structures.
Currently, the Highway Department is investigating these improvements and will contact
Estridge Development once they have been determined. Please be aware that this will
need to be resolved before the Highway Department will approve the plans for Hoover
Heights.

Defmed floodplain boundaries for Clay Creek have not been mapped by DNR, and, since the
upstream drainage area is less than one square mile (375 ac. +/-), this project does not fall under
DNR jurisdiction.
The proposed location of 126t~ Street can be accommodated along the Sontbem boundary oftbe
site without encroaching into any lots. It's extension through the Village of West Clay will align
the Northern right-of-way line with Hoover Height's South property line.
The Cox property is not land locked. Their property extends via a narrow strip to Hoover Road
between Hoover Heights and Claridge Farm.
Enclosed is a variance application to eliminate the street stub.
The accel/decel lanes have been revised to meet the request and requirements of the Hamilton
County Highway Department.
The right-of-way for Hoover Road is denoted.
A pathway has been added along the East side of Hoover Road.
Comer lots 11 and 17 have been increased in size.
The proposed water and hydrant locations are being reviewed by the Fire Department.
It is our opinion the open spaces provided are easily accessible from various points and that trail
linkages between lots are unnecessary.
The uses of the natural open space are intended to be passive, protect scenic views and minimize
views of new development from existing roads.
The retention pond located in the creek corridor has been relocated to the sides of the creek.
The width of pipeline easements is denoted.
A landscaping and tree preservation plan will be forwarded to you by Estridge Development.

Comprehensive Plan Compliance Statement
The proposed Developmeneomplies with both the Carmel/Clay 2020 Vision Plan adopted
September 24, 1996 ("Plan") and the Ordinance to Implement the Policies of the Plan passed May
19, 1997. The real estate to be developed lies within an area targeted for Very Low Residential
which the Plan defines as 1.0 to 1.3 dwelling units per acre and notes Claridge Farms as an example
of this. The development will have 1.24 dwelling units per acre.
Further, the development is consistent with the Plan policies for Very Low Intensity Residential in
