Legal Counsel Report, John Molitor: Copies of a Motion filed by Kensington Place HOA VS Justus Homes were distributed to Plan Commission members this evening as well as the Objection to their Response. This does not require an Executive Session or discussion, but it would be good for the Commission Members to read the documents and if need be, ask any questions after the meeting. Reports, Announcements, Dept Concerns, Angie Conn: Item 3, Gramercy PUD (Mohawk Hills Redevelopment) has been TABLED to the December 20, 2011 meeting; the attorney for the petitioner would like to address the Commission this evening and request a suspension of the Rules of Procedure. Additionally, Adrienne Keeling, DOCS, asked to up -date the Commission regarding the Carmel Drive/ Range Line Road Overlay Ordinance Amendment. Adrienne Keeling reported on the City Council action regarding the Carmel Drive/Range Line Road Overlay Zone Amendment. The Plan Commission sent the proposed Amendment to the City Council with a favorable recommendation which eliminated the expiration date of the Sunset Clause. The Council approved an Amendment to the Ordinance which extends it for another year, and then adopted the Amendment however, since it was changed from the certification of the Plan Commission, the Commission will need to vote to either affirm or deny the Council's action. Tim Ochs, attorney with Ice Miller, addressed the Plan Commission on behalf of Buckingham Companies, the applicant for Gramercy PUD (Mohawk Hills Redevelopment.) Mr. Oaks requested suspension of the Plan Commission's Rules of Procedure with respect to the Public Notice requirement. The notices that were mailed to adjoining property owners for the matter being continued tonight were not sent in a timely fashion. As more issues and changes occurred, the decision was made to Table this item. However, in order to continue an item, it must be properly on the Agenda in the first place, and it is not properly on the Agenda until the Rules are suspended to allow the continuance. The notices were sent out at least 10 days in advance to comply with State Statute; the notices were sent Certified Mail, followed up with a letter to every person entitled to receive notice, letting them know that we would be requesting a continuance to the December 20 Plan Commission meeting. All of the appropriate property owners have been notified and are aware of what is going on. If the suspension does not occur, it would force the petitioner to send out a new notice using Certified Mail, which we would like to avoid. 1) It would probably cause some confusion with respect to surrounding property owners, and 2) Some persons get upset that they have to trek to the post office to pick up a certified notice and maybe spend time standing in line. At this time, the petitioner is requesting a suspension of the Rules of Procedure that would allow continuance of tonight's hearing without having to send additional notice by Certified Mail. Motion: Woody Rider to suspend the Rules of Procedure based on requiring the petitioner to send another letter to surrounding property owners —more notice than received for this original meeting and sending another notice by regular, first class mail, without having the additional expense of another certified letter; seconded by Ephraim Wilfong. The vote was 7 in favor, two opposed (Potasnik Westermeier) MOTION DENIED The petitioner will be required to send an additional Certified Mail Notice to surrounding property owners regarding the Gramercy PUD. Southern portion of Illinois Street? Retention pond? If permanent pond, would like vegetation barrier at pond's edge to keep geese out Landscaping should be in keeping with overall "Prairie" theme e Types of Care? Illinois Street is to be constructed (at a minimum) to the drive entrance before Certificate of Occupancy is issued. As part of Development Plan and review process, petitioner submitted to Dept the pedestrian connectivity plan which goes all around the site as well as through the site. Asphalt paths will be constructed along Spring Mill Road along with phases of development as well as along Illinois Street continuing south to 106'' Street where it will align with existing street. Through the HealthSouth site, there will be a walk constructed on the south side of the drive, ultimately another north/south pedestrian connection as well as three east/west connections between 116 Street and I I I Street. A sidewalk will be constructed south of the property, along the southern-most drive as part of the connectivity plan. Petitioner is working with adjoining owners to provide alternates to detention facilities. The design is being reviewed by the Engineering Dept –a temporary but could be permanent solution. If there is an alternative that opens up this area for more intense, tax- generating benefit, the petitioner will seek approval to develop and handle the detention in an alternate manner. Today, HealthSouth would like to move forward and the proposed solution meets all the requirements of the Ordinance Note: Part of the future solution is part of the Illinois Street solution; the drainage for this parcel is all part of the project. The City does not have right -of -way for the total of Illinois Street; however, the Mayor has stated intention to have Illinois Street built in 2012.
