RE: 1200 West Carmel Drive - Shepherd Insurance
The Zoning Ordinance for the City of Carmel requires the installation of sidewalks with all projects,
whether commercial or residential, per the requirements of the City's adopted Thoroughfare Plan.
When approved in October 1995, the site plan for the Shepherd Insurance building provided for
dedication of ten feet of additional right -of -way along Carmel Drive, for a total Y2 right -of -way of
forty-five feet (45'). Also included on the plan was a five foot (5') wide concrete sidewalk to be
installed one -foot inside the right -of -way line (attached), which was the City's standard at the time.
Construction of the sidewalk was deferred to the future, agreed to by the City in 1995, due to the
absence of connecting sidewalks in the area. At the time, it was discussed about the possibility of
the owner making payment to the City for the cost of sidewalk installation, rather than actually
building it, but final agreement for that was never finalized. This option would allow the property
owner a choice of either constructing the sidewalk, or pay the equivalent amount to the City, based
upon an engineer's construction cost estimate.
In 2001, the City of Carmel's Thoroughfare Plan requirements were amended to provide for parallel
ten foot (10') wide multi - purpose paths along Carmel Drive rather than sidewalks. The most current
version of the Plan maintains the provision for ten foot (10') wide multi - purpose paths along Carmel
Drive within a one hundred (100') street right -of -way.
While the previous sidewalk requirement remains unfulfilled, the City requests that any new
improvements or changes planned to the Shepherd property now include construction of a 10 -foot
wide multi - purpose path, in compliance with the current Thoroughfare Plan.

Pursuant to our discussion today, please note the following.
The City of Carmel's standard•for public sidewalk installation.location along Carmel Drive is one
foot• (1') within the street right-of-way. In the case• of this project, it would occur within the
newly established 45' half right -of,- -way.
Tree clearing for the walk within the preservation area is to .be minimal, preferably an area equal
to the width oftlie walk (h5'), plus one,foot (1') of clear area on each side (seven feet.total). The

LANDSCAPE REQUIREMENTS
Dear Mike.
We have received a copy of the DOCD Recommendations for our project that you presented at
the Special Study Committee meeting on Tuesday, October 3. A copy of which is attached
hereto.
As we stated during the meeting, we agree to the requirements with the exception of the request
to provide an accurate survey of the North property line. In addition, you will need to provide
the documents for my signature necessary to dedicate the additional right of way.
I have instructed Bremner & Wiley and Ken Remenschnieder to amend the plans accordingly.
