Findings of Fact GREYHOUND COMMONS~ PHASE II PROJECT OVERVIEW Kite Development Company has filed a Developmental Standards Variance application for the parking for the four restaurants to be located at the southeast corner of 146th Street and Keystone Avenue, just south of the existing Lowe's building. This property is located in a Planned Unit Development (PUD) district that includes the Lowe's building. Abuelo's has been designated for one of the four restaurants with specific ADLS plans approved by the Plan Commission. A Fox and Hound restaurant has been proposed just east of the Abuelo's. The landscaping, lighting and signage are proposed to be consistent among all four restaurants. Kite proposes that the parking ratio used for restaurants be changed from 1 space per 2.5 patron seats to 1 space per 3 patron seats. The new ratio will be consistent or more restrictive than surrounding communities' parking requirements including: Indianapolis: 1 parking space per 4 patron seats Westfield: 1 parking space per 3 patron seats; and Fishers: 1 parking space per 3 patron seats The variance will provide for adequate parking for the four restaurants in the amount of 514 parking spaces and will allow for more parking lot landscaping throughout the site. 75' 75' :i : . , t -A Y- ~Z ~ Revisions Proposed Parking Variance .o. FINDINGS OF FACT - DEVELOPMENTAL STANDARDS VARIANCE The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: the property owner will provide adequate off street parking for customers and employees of the restaurants. . The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: the property owner will provide adequate off street parking for customers and employees of the restaurants. , The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: the Zoning Ordinance requires an excessive amount of parking spaces that results in a less attractive site. DECISION IT IS THEREFORE the decision of the Hearing Officer of the Carmel Board of Zoning Appeals that Developmental Standards Variance filed as Docket No. 04060015 V is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
