The applicant seeks the following development standards variance'
Docket No. 04060016 V Chapter 25.7.02-10 (b) # signs per frontage
The site is located at 12800 N Meridian St. The site is zoned B-2/Business within the US 31 Overlay

Analysis'.
General Information:
The petitioner would like to
place a wall sign on the south
faCade of the building. The
variance is to allow a third
wall sign to be located on
Hamilton Crossing West,
Building 3.
Background
Information-
In the past, there was
discussion between the
Department and the petitioner
as to which frontage would be
allowed a sign, due to 2
frontages ( the south and west
elevations) facing the same
street.
The sign ordinance permits one sign per frontage. The dominant frontage determines the frontage. In
essence, 2 elevations of building 3 face 126th street, since the street curves upward. The 2 signs on the
east frontage facing US 31 was allowed by a previous variance. This item, for the FCCI sign, also
appeared before the Special Studies Committee on July 6, 2004 and received a favorable vote of 4 to 0.
Findings of Fact:
1.) The approval of this variance will not be injurious to the public health, safety, morals,
and general welfare of the community because: Signage is a necessary criteria for a
business' success. The sign on the south facade will still face a street frontage.
2.)
The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because:
The sign on the south faCade will look more pleasing, rather than placing it with the 2 existing
signs on the east facade. The sign will still be able to be seen from northbound traffic on US 31,
but the placing of it will look better.
3.)
The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because:
The strict application of the Zoning Ordinance may result in practical difficulties in the use of
the property due to fact that sign would not be able to be placed on the site. The building
already has fulfilled its signage requirements for 2 signs, based on two road frontages.
Recommendation:
The department recommends positive consideration of Docket No. 04060016 V.
