The applicant seeks use variance approval for a charter school.

The site is located at 530 West Carmel Drive and is zoned M-3/Manufacturing Park District. Filed by

The students are in
grades 9-12.
Background Information:
The petitioner appeared in front of the Technical Advisory Committee on August 18, 2004. Most
departments had no comment. However, the City would like the petitioner to install a 5-ft sidewalk
along Carmel Drive, pursuant to the Alternative Transportation Plan. The petitioner brought up the
fact that a bond was posted for the sidewalks about 6 years ago, but the City let the bond expire.
The petitioner should be prepared to address this issue in more detail.
Analysis'.
The M-3/Manufacturig zone is supposed to have a mix of uses in which all take place within enclosed
buildings. The use of this site for a charter school is suitable for the area. It will also allow a current
asset to the community to relocate to a new site, yet still be in Carmel.
Findings of Fact:
1.) The grant of this variance will not be contrary to the public interest, due to the existence
of a special condition such that enforcement of the zoning ordinance will result in
unnecessary hardship because: The school will not be able to relocate to this site, limiting the
number of students it can accept at its existing site.

The grant of this variance will not be injurious to the public health, safety, morals, and

create adverse noises or views.
The use or value of the area adjacent to the subject property will not be substantially

The need for the variance arises from a natural condition peculiar to the subject property

The granting of this variance does not substantially interfere with the Carmel/Clay
Comprehensive Plan because: The Comprehensive Plan designates this area as low-intensity
regional employment area. The proposed use will compliment the existing surrounding uses.
Recommendation:
The department recommends positive consideration of Docket No. 04070019 UV with the following
condition: that the petitioner installs a 5-ft sidewalk along Carmel Drive.
