HomeMy WebLinkAboutD-2079-12 Transfer Keystone Ave. to Utility Relocation for US31ORDINANCE D- 2079 -12 Sponsor: Councilors Rider, Sharp, Seidensticker Snyder AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA APPROVING THE TRANSFER OF FUNDS FOR REIMBURSEMENT OF UTILITY RELOCATION IMPROVEMENTS RELATED TO THE KEYSTONE AVENUE PROJECT WHEREAS, pursuant to Ordinance No. D- 1871 -07 (as amended), adopted by the Common Council of the City of Carmel (the "Council on October 1, 2007, the Council adopted a new Section 2 -129 of Chapter 2, Article 4 of the Carmel City Code (the "City Code which created the Non Reverting Keystone Avenue Improvement Fund #920 the "Keystone Avenue Improvement Fund and WHEREAS, pursuant to Chapter 2, Article 4, Section 2 -129 of the City Code, the Keystone Avenue Improvement Fund is to be used exclusively for the purpose of accepting and disbursing moneys received from the Indiana Department of Transportation and disbursed for projects consistent with the improvement by the City of Carmel, Indiana of Keystone Avenue (the "Keystone Avenue Project and WHEREAS, Carmel. Utilities (the "Utility") made certain utility relocation improvements for the Keystone Avenue Project; and WHEREAS, the Council now desires to reimburse the Utility for costs of the utility relocation improvements in the amount of One Million 'Five Hundred. Thousand Dollars ($1,500,000). NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, as follows: 1. The Council hereby approves the reimbursement of the Utility for costs of the utility relocation improvements for the Keystone Avenue Project and approves the transfer of funds in the amount of One Million Five Hundred Thousand Dollars ($1,500,000) from the Keystone Avenue Improvement Fund #920 to the Water Construction Fund #612 to effect the reimbursement. 2. This Ordinance shall be in full force and effect from and after its passage by the Council and approval by the Mayor as required by law. rCi ADOPTED by the Common Council of the City of Carmel, this 0 day of J a nuokr 2012, by a vote of '7 ayes and nays.
