The Court having previously entered its ENTRY AND ORDER signed on
December 30, 2011 and filed on January 3, 2012, and this Court upon
review determines that the total just compensation and total appraisers'
fees was incorrectly inserted. The Court now amends ENTRY AND ORDER
Nunc Pro Tunc as follows:
The Court appointed appraisers have filed their reports in which they
determined that the Defendants, Clay Terrace Partners, LLC, a Delaware
limited liability company Clay Terrace Nomura Credit Capital, Inc., a
Delaware corporation Normura and Bank of America, N.A., as Trustee
for the Registered Holders of Wachovia Bank Commercial Mortgage Trust,
Commercial Mortgage Pass Through Certificates, Series 2006 -C23 Bank of
America may be entitled to total just compensation in the amount of $31,
850.00. The Court, being duly advised, now ORDERS, ADJUDGES, AND
DECREES that:

1. The Plaintiff, the City of Carmel, shall pay to the Clerk of this
Court the total appraisers' fees in the amount of $3,000.00
within thirty (30) days of this Amended Entry and Order.
2. The Clerk of this Court, upon receipt of the above referenced
payment, shall pay each of the appraisers his or her respective
share and shall deposit any additional amounts in an interest
bearing account pending further order from this Court.
3. The Clerk of this Court shall send a copy of the Report of
Appraisers and a copy of this Entry and Order, by Certified Mail,
to all parties or counsel of record for all parties to this action.
