3d. Mayflower Park, Blk 1, lots 2 & 5 - Off-premise sign
The applicant seeks the following development standards variance:
Docket No. 04080025 V Chapter 25.07.01-04(1) prohibited signs
The site is located at 9770 Mayflower Park Dr. The site is zoned I-l-Industrial.

General Info:
The petitioner seeks
approval to place a sign
off-premise, just 30 feet
from the property line.
The sign ordinance
specifies that signs must
be on-premise and that
off-premise signs are
prohibited.
Analysis'.
The lot, which houses the
businesses that the ground
sign refers to, has a 15- ft
frontage onto Mayflower
Park Drive. This strip of
land is taken up by asphalt drive, which is the access to the lot/businesses. There is no other place to
place the ground sign so that it has effective visibility from Mayflower Park Drive. If the sign were
required to be placed on the subject property, it would be over 300 feet from Mayflower Park Drive.
Findings of Fact:
1.) The approval of this variance will not be injurious to the public health, safety, morals,
and general welfare of the community because' The awkward lot size does not lend itself to
having a sign property situated to have visibility from Mayflower Park Drive. The placement of
the sign on the adjacent property will not be negative to the industrial area.
2.) The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because:
It is the Department's opinion that the use and value of the area adjacent to the property will
not be affected in a substantially adverse manner by allowing the ground sign to be placed on
the adjacent property. Due to the awkward lot frontage, the adjacent property is the only logical
place to put the ground sign.
3.) The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because:
The strict application of the Zoning Ordinance may result in practical difficulties in the use of
the property due to the fact that the sign would have to be placed over 300 feet from the road
fight of way, rendering its purpose as an identification sign as futile.
Recommendation: The staff recommends positive consideration of Docket No. 04080025 V.
