HomeMy WebLinkAboutPacket 01-24-12THE CARMEL /CLAY ADVISORY BOARD OF ZONING APPEALS Docket Nos. 1 l 120019V and 11120020V Statement of Variance Petitioner, The Fineberg Group, LLC, seeks a variance from the Carmel Drive - Rangeline Road Overlay Zone ordinance, specifically section 23F.13.01A, which prohibits ground signs in the zone. It is also seeking a variance from the Sign Ordinance, specifically section 25.07.02 - 9(b), which requires that tenants share equally on ground identification signs in a Multi- Tenant Ground Floor Building. If the variances are granted, Petitioner will remove the existing legal non - conforming pole sign and replace it with a multi- tenant, illuminated ground identification sign. THE CARMEL /CLAY ADVISORY BOARD OF ZONING APPEALS Docket No. 11120019 V and 11120020 V Statement of Support In support of the requested variances, The Fineberg Group, LLC notes that approval of the variance will not be injurious to the public health, safety, morals or general welfare of the community as no illegal or immoral copy will be permitted on the sign. There is already an existing illuminated pole sign on the exact site Petitioner wishes to establish a ground sign. The use and value of adjacent property will not be affected in a substantially adverse manner, as many, if not all, of the adjacent property owners signs and several businesses in the surrounding area within the overlay zone, have ground signs. In fact, the removal of a pylon sign and its replacement with an attractive ground sign will further add to the beautification of Range line Road, thereby increasing value to adjacent properties. If the ordinance were strictly applied, the ground sign would not be permitted, making it more difficult for businesses within the center to safely and effectively advertise the location of their stores. Also, the petitioner would not be able to proceed financially with the project as much of the funding is coming from a tenant who requires a larger presence on the sign.
