Dear Ms. Solada:
At the meeting held Monday, September 27, 2004, the Cannel Advisory Board of Zoning Appeals took the following
action regarding the Developmental Standards Variances (V) filed by you for the property located northeast of 99~ Street
and Michigan Road/US 421'
APPROVED: Docket No. 04050029 V Development Standards for foundation plantings. The Board voted five (5) in
favor, zero (0) opposed, thereby approving the petition.
APPROVED: Docket No. 04050030 V Development Standards regarding access with CONDITION (subject to the
filing of recorded commitments concerning access geometries, timing, and the extension of Commerce Drive and
improvements to 96ta Street). The Board voted five (5) in favor, zero (0) opposed, thereby approving the petition.
APPROVED: Docket No. 04050033 V- 04050036 V and 04070008 V Development Standards regarding signage.
The Board voted five (5) in favor, zero (0) opposed, thereby approving the petition.
APPROVED: Docket No. 04070009 V and 04070010 V Development Standards regarding fagade design. The
Board voted five (5) in favor, zero (0) opposed, thereby approving the petition.
Please be advised that per Section 30.05.05: Time Limit of the Zoning Ordinance, the aforementioned Development
Standards Variances approval is valid for one (1) year. By that time, either continuous construction of the
improvements must be underway, or a written request for a one-time, six-month extension of the approval must have
been received and approval granted by this Department. The expiration date of the approval is September 27, 2005.
Please be advised that per Seca'on 25.07.07: Sign Permits of the Zoning Ordinance, the signs approved pursuant to
the aforementioned Development Standards Variances must be established within one (1) year. The expiration date
of the approvals is September 27, 2005.
When applying for applications for permits regarding the improvements contained within this approval,
please include a copy of this letter with your application materials in order to assist the Department's review.
