The site is located at 3800 E 96th Street. The site is zoned B-3/Business.

The petitioner is seekin~ a
variance to allow a
second sign on the 96th
street frontage. The
proposed amendment to
signage on the site has
been presented to the Plan
Commission's Special
Studies Committee and
the design location was
approved on October 5,
2004.
Analysis'.
The need for two signs on the 96th street frontage arise fro the fact that the Car Dealer must be
identified, Ed Martin, as well as the car brand specific to the site, Acura.
Findings of Fact:
1.) The approval of this variance will not be injurious to the public health, safety, morals,
and general welfare of the community because' an existing wall sign is being removed on
the 96th street frontage and, in its, place, a wall sign is proposed. The total number of signs on
the property will not change, only the number of signs on the 96th Street frontage.
2.)
The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because:

3.)
The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because:
this type of business relies on visibility along a busy road corridor; the tenant may not be able
to properly compete with other car dealers along this corridor.
Recommendation:
The department recommends positive consideration of Docket No. 04100020 V.
