The applicant seeks the following development standards variance approval:
Docket No. 04110021 V Chapter 25.07.02-10(b) two signs oriented east
The property is located southwest of 131 st Street & US 31 and is zoned B-5/Business within the US 31
Overlay Zone. Filed by Steve Granner -Bose McKinney & Evans LLP for SM&P Utility Resources, Inc.
General Info:
The applicant seeks to transfer a sign
allowed on the west frontage to the
east frontage, in order to face US 31.
This action will need a variance
approval for the number of signs,
since there is currently a sign on the
east fagade,
Analysis'.
The tenant's sign will have more
visibility when facing US 31, rather
than Meridian Comers Drive. Also,
the sign will face a busy corridor,
rather than a tranquil residential area.

Findings of Fact: number of
signs per frontage
The approval of this variance will not be injurious to the public health, safety, morals,
and general welfare of the community because: the petitioner is moving one sign, allowed
by the Sign ordinance, from the Meridian Comers frontage to the Meridian Street frontage.
This will benefit users of the US 31 Highway for visibility purposes, and it will benefit the
resident to the west of Meridian Comers St.

The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because:
the sign will not be facing the Meridian Comers frontage and residential uses to the west of the
Street. This will benefit users of the US 31 Highway for visibility purposes, and it will benefit
the resident to the west of the Hamilton Crossing West office buildings.
The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because'
The strict application of the Zoning Ordinance may result in practical difficulties in the use of
the property, due to fact that the tenant may not be able adequately identify its location, because
it will not be facing a highly traveled road frontage. Residents to the west of the site may also
be impacted negatively if the sign were placed on the west faCade.
Recommendation'.
The Department recommends positive consideration of Docket No. 04110021 V.
