The applicant seeks the following development standards variance approvals:
Docket No. 04110025 V Chapter 25.07.02-i0C0) sign oriented south
Docket No. 04110027 V Chapter 25.07.02-10(c) sign size
The site is located southwest of 103rd Street and Meridian Street. S 31.
The site is zoned B-I/Business within the US 31 Overlay Zone.

General Info:
The petitioner requests approval to take a wall
sign from the 103rd Street frontage and move it to
the 1-465 frontage.
Analysis:
The property owner would like to have one of
their tenants to have a wall sign facing 1-465.
There is a parcel of land that separates the said
property from the interstate highway, but the
proposed location of the sign will have more
visibility facing 1-465, rather than 103~a Street.
Since the sign will be so far from 1-465, the size
has been increased to more than what would have
been allowed had the sign been located on the
103ra Street fagade: 105 sq ft vs. 147 sq. ft. Again,
the greater sign size is to have visibility form 1-
465.
Findings of Fact: Sign Area
1.) The approval of this variance will not be injurious to the public health, safety,, morals,
and general weffare of the community because: The sign location and size allow drivers to
recognize the site earlier and be able to make better driving decisions when changing lanes and
mming.
2.) The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because:
The signs are proportionate to the size of the building and will not affect adjacent property
values.
3.) The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because'
The strict application of the Zoning Ordinance may result in practical difficulties in the use of
the property due to fact that the owner might have to relocate a sign to the north fagade so that
it faces a road frontage with less visibility.
Findings of Fact: Sign with no frontage
1,) The approval of this variance will not be injurious to the public health, safety, morals,
and general weffare of the community because: The sign location may allow drivers on 1-465
to recognize the site earlier and be able to make better driving decisions when changing lanes
and turning.
2.) The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because'
The sign location on the south facade fits the architecture elements of the building and will not
affect adjacent property values in this area.
3.) The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because:
The strict application of the Zoning Ordinance may result in practical difficulties in the use of
the property .due to fact that the owner might have to place the sign on the 103~a Street frontage,
which has substantially less amount of visibility.
Recommendation:
The depamnent recommends positive consideration of Docket No. 04110025 V and
Docket No. 04110027 V.
