Dear Mr. McComas:
At the meeting held Monday, December 13, 2004, the Carmel Advisory Board of Zoning Appeals took the following
action regarding the Development Standards Variances (V) filed by you for the property located at the southeast comer
of 97st Street and Michigan Road:

APPROVED: Docket No. 04110012V Development Standards Variance Application for 3-acre minimum. The
Board voted five (5) ia favor, zero (0) opposed, thereby approving the petition.
APPROVED: Docket No. 04110014V Development Standards Variance Application for foundation plantings. The
Board voted five (5) in favor, zero (0) opposed, thereby approving the petition.
APPROVED: Docket No. 04110016V Development Standards Variance Application for perimeter plantings. The
Board voted five (5) in favor, zero (0) opposed, thereby approving the petition.
APPROVED: Docket No. 04110017V Development Standards Variance Application for drive-thru location. The
Board voted five (5) in favor, zero (0) opposed, thereby approving the petition.
APPROVED: Docket No. 040110018V Development Standards Variance Application for signage type. The Board
voted five (5) in favor, zero (0) opposed, thereby approving the petition with the following CONDITION:
1) All perpendicular signs must be uniform in size and color.
MOVED: Docket Nos. 04110013V and 04110015V Development Standards Variance Applications for setback and
buffer yard to the January 4, 2005 Hearing Officer meeting and any new fees pertaining to these two dockets would
be waived. The Board voted five (5) in favor, zero (0) opposed, thereby approving the motion.
Please be advised that per Section 30.05.05: Time Limit of the Zoning Ordinance, the aforementioned Development
Standards Variances approval is valid for one (1) year. By that time, either continuous construction of the
improvements must be underway, or a written request for a one-time, six-month extension of the approval must have
been received and approval granted by this Department. The expiration date of the approval is December 13, 2005.

Please be advised that per Section 25.07.07: Sign Permits of the Zoning Ordinance, the signs approved pursuant to
the aforementioned Development Standards Variances must be established within one (1) year. The expiration date
of the approvals is December 13, 2005.
When applying for applications for permits regarding the improvements contained within this approval,
please include a copy of this letter with your application materials in order to assist the Department's review.
