Carme~Clay Zoning Board, Thank you for considering my commcn~s r~garding the variance oflo~ #39, which lies next to my property (lot 38). I am not obje~ng to the consmlction of the proposed project, but only the variance conditions. I object to variance of the Carmel ordinance, which moves the project from 50 fi. ~o 35 fl from my residence, and reduces the buffer zone from 15 fl. to 5 fl. This will put a drive thru 20 fi. from my aclual home, and places the alignment and lube shop $5 fL away. Another concern is the reduction in fence size in tho plans from $ to 6 fl. The developer's petition does not meet the standards for variance. #1. It causes a safety, ba~ordou~ ~, and noise issue due m the close proximity of the project. #2, It will adversely affect tho value and use of my property in an adwrsc manner, esp~ialiy since ! will have a busy drivo thru fight next to my house. #3, It certainly affocLs my family's quality of life~ and it is unfair to allow retail center to exist fi. gilt by the back door of my home. 1 would also ask tho commit~ to take into consideration that the .family lied to the zoning commission during tho Sept~m~r m~g stating th~ they had purchased my property. They followed this up by tolling tho commission during the November 15~ meeting ~at they were still tryin~ to by my proporty although no offers were made since Seplem~. I believe that these mism~$ may have effected the Zoning Commisaioll'$ decisions regar~ this project. The issue is risk. i would suggest you quickly define needed variances. I could put you in front of special studies committee in October prior to Public Hearing with ADLS Amendment for building to remain. This may allow you to "make your case" on rest of project and get the committee comfortable with it to see if they would suspend after the public hearing. BZA would be after that. Are there any big changes to the plan from the last TAC? If not I would be glad to put this on the Plan Commission agenda for September. If you feel you need to go back to TAC for more input we still could but not as the official visit. Again I am uncomfortable pushing the commission on the issue of process. · Thanks, Jon ..... The project needs variance approval, etc. If no one showed up at the public hearing and there were no questions from the Commission it would still take a suspension of the rules. We could not get the Commission to approve a suspension last month on a project without remonstrance that complied with all aspects of the ordinance.
