The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The city is working with the sign variance, a variance is the least burdensome method to obtain the desired goal, and the variance will assist in identifying the church entrance and parking to patrons. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The signage is no different from the surrounding businesses, the area has similar signage, and the sign would not be unreasonably obstructive. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: The sign will clearly and adequately identify entrances to avoid patron confusion caused by the the newly installed median and the sign will also assist in public welfare and safety by clearly marking the entrance. IT IS THEREFORE the decision of the Carmel /Clay Board of Zoning Appeals that Development Standards Variance Docket No. is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof. Page 10 of 11 filename: development standards vanance 2011.doc rev. 12/28/2010 STATEMENT OF VARIANCE CARMEL /CLAY ADVISORY BOARD OF ZONING APPEALS Docket No. 12010001 V This application for variance is concerning the Carmel United Methodist Church (CUMC) constructing a new sign identifying the church and church parking for patrons of the CUMC's parking lot. The proposed sign deviates from the Carmel /Clay Zoning Ordinance 25.07.02.07(b) total number of signs allowed, by one (1) sign. The ordinance allows three (3) signs and the proposed sign would bring CUMC's sign total to four (4). The affected property's address is located at 120 E. 126th Street. The Legal Description describing the real estate can be found at Book 342 Page 8 and is attached for reference. STATEMENT OF SUPPORT CARMEL /CLAY ADVISORY BOARD OF ZONING APPEALS Docket No. 12010001 V In support of the variance for the Carmel United Methodist Church (CUMC), CUMC offers the following for consideration: 1. CUMC wants the proposed sign because CUMC has a stated goal of helping the public and the sign will be beneficial is aiding public safety. 2. Due to the newly installed median on 126th Street, the parking entrance for patrons heading east is obstructed which creates an unnecessary inclination by the patron to make a potentially dangerous U -turn when a safer and more direct entrance exists farther down the road. 3. The proposed sign will identify the more direct entrance to the church and church parking and with added way finding, patron confusion is limited and safe access is the clear and adequately identified. 4. The City of Camel (City) is routinely host to events where the church parking lot is used by the public and during these events; the proposed sign will help patrons of said events to locate the area safely. 5. The City will also benefit from the proposed sign because general welfare of the public is served by limiting dangerous intersection U- turns, clearly making the entrance visible for access, and increasing safety for visitors. Additionally, the surrounding signage is similar to the proposed sign and the sign would not be unreasonably obstructive. CUMC believes the variance is the least burdensome method to obtain the desired goals stated above and the public will receive a great benefit from the sign which are in line with CUMC's desired goals.
