Legal Description
A part of the Southwest Quarter of Section 36, Township 18 North, Range 3 East, described as
follows'
Begin at a point 66.0 feet west and 475.0 feet south of the Northwest comer of the East Half of the
Southwest Quarter of Section 36, Township 18 North, Range 3 East, thence east 727 feet to an iron
stake in the fence, said point being 475.9 feet south of the North line of said Southwest Quarter,
thence south on and along a fence line 302.0 feet to an iron stake, thence westerly 729.4 feet to a
point, with the intersection of a line 66.0 feet west of the west line of said East Half, thence
northerly on and along said line 296.4 feet to place of beginning. Containing 5.0 acres more or less
including the center of the Road.

STATEMENT OF COMPLIANCE WITH THE COMPREHENSIVE PLAN
This property is designated as a "Regional/County Employment Area" by the Carmel/Clay
Comprehensive Plan. Figure 2 of the Carmel/Clay Comprehensive Plan, entitled "Carmel/Clay
Township Proposed Growth Policies, Regional/Community Employment Areas" indicates that the
character of low intensity commercial development includes one to two story offices, office
showroom floor space, and industrial warehouses. The proposed townhomes are a less intense use
than contemplated by the Comprehensive Plan.
OWNER'S CONSENT
James R. ~egkley, the undersigned, the owner (the "Owner") of the real estate more
particularly descrii~¢~d in what is attached hereto and incorporated herein by reference as Exhibit
"A", hereby (i) authorizes Nelson & Frankenberger, and its attorneys, Keeler-Webb Associates
and its agents and representatives, and Crawford Development, LLC, and its agents and
representatives, to represent the Owner in connection with all proceedings (the "Proceedings")
before the Carmel Plan Commission and City Council of the City of Carmel, to obtain the
approval of a PUD Ordinance, ADLS, DP, and any other approvals governing the use and
development of the Real Estate, and (ii) consents to and joins in the Proceedings and any
petitions and applications filed in connection with the Proceedings.
