Please let me know if you suggest anything further. Commitments- I have determined that the commitments made in connection with the existing zoning were never recorded. I still think it would be helpful, however, to obtain a certification, from the Department, that the commitments made in connection with the existing zoning are ineffective by reason of the subsequent rezone. Please give me your thoughts. As always, we appreciate your help. Frankenberger AGREEMENT TO INSTALL FENCE AND WATER LINE THIS AGREEMENT (the "Agreement") is made and entered into by and between Crawford Development, LLC, an Indiana limited liability company ("Crawford") and William R. Johnson ("Johnson"), and is signed on the dates indicated below, WITNESSETH' WHEREAS, Crawford is the contract purchaser of the real estate described in what is attached hereto and incorporated herein by reference as Exhibit "A" ("Parcel 1"); WHEREAS, Crawford has filed an application, with the Carmel-Clay Plan Commission, to change the zoning of Parcel 1, which application is pending under Docket Number 04-01- 0024Z; WHEREAS, Johnson and his wife are the owners of the real estate described in what is attached hereto and incorporated herein by reference as Exhibit "B" ("Parcel 2"); WHEREAS, Johnson's residence (the "Residence") is located on Parcel 2, and the water to the Residence is serviced by a well (the "Well") located upon Parcel 2; WHEREAS, on the terms and conditions which follow, Crawford has agreed (i) to install a fence at or near the boundary line separating Parcel 1 and Parcel. 2 and (ii) install a water line from Parcel 1 and connecting to the Residence. NOW, THEREFORE, in consideration of the foregoing preambles and recitations, it is acknowledged and agreed as follows: 1. Upon the cleating and grubbing of Parcel 1, Crawford shall cause to be installed a three board split rail fence without mesh, an illustration of which is attached hereto and incorporated herein by reference as Exhibit "C" (the "Fence"), in the location specified on the drawing attached hereto and incorporated herein by reference as Exhibit "D". The highest of the three (3) horizontal rails of the Fence shall be approximately four (4) feet above grade; 2. Installation of Water Line. When on-site water mains and laterals are installed upon Parcel 1, Crawford shall cause to be extended a water line, north from Parcel 1 to Parcel 2, and connecting to the Residence at a point adjacent to the Well. Regarding the installation of such water line, the parties further agree as follows' (a) Crawford shall pay the availability and connection fees assessed in order to make water available to the Residence on; (b) Within seven (7) days after payment of such water availability and connection fees, Johnson shall pay to Crawford the sum of One Thousand Dollars ($1,000.00); (c) Crawford, at its expense, shall (i) mn the water line north from Parcel 1 and across Parcel 2 to the Residence and (ii) actually connect the water line to the Residence turnkey, at a place adjacent to the Well, at .a time prior to the obtaining of the first certificate of occupancy for the first townhome residence located on Parcel 1; and (d) Any subsequent abandoning and capping of the Well shall be the Johnsons' obligation and expense. 3. Effective Date. This Agreement, and the obligations of the parties under this Agreement, shall not be effective until the occurrence of all of the following, and shall be null and void absent the occurrence of all of the following: (a) The acquisition by Crawford of Parcel 1; (b) The enactment of a PUD Ordinance rezoning the real estate as requested under Docket No. 04-01-0024Z; and (c) The commencement of development of the real estate by Crawford or its successor or assign. This soil is located on depressions and is subject to ponding; slopes are 0 to 2 percent. The native vegetation is water tolerant grasses and hardwood trees. The surface layer is silty clay loam and has moderate to high organic matter content (2.0 to 6.0 percent). Permeability is moderately slow (0.2 to 0.6 in/hr) in the most restrictive layer above 60 inches. Available water capacity is high (10.0 inches in the upper 60 inches). The pH of the surface layer in non-limed areas is 6.0 to 7.3. This soil is hydric. Wetness is a management concern for crop production. This soil responds well to tile drainage; it is designated not highly erodible (class 3) in the Highly Erodible Land (HEL) classification system. CrA Crosby silt loam, 0 to 3 percent slopes This is a somewhat poorly drained soil with a seasonal high water table at 0.5 to 2.0 ft. This soil is located on rises on till plains; slopes are 0 to 3 percent. The native vegetation is hardwood forest. The surface layer is silt loam and has moderately low to moderate organic matter content (1.0 to 3.0 percent). Permeability is very slow (< 0.06 in/hr) in the most restrictive layer above 60 inches. Available water capacity is moderate (6.2 inches in the upper 60 inches). The pH of the surface layer in non-limed areas is 5.1 to 6.5. Droughtiness and wetness are management concerns for crop production. This soil responds well to tile drainage; it is designated potentially highly erodible (class 2) in the Highly Erodible Land (HEL) classification system. Sh Shoals silt loam This is a somewhat poorly drained soil with a seasonal high water table at 0.5 to 2.0 ft. This soil is located on flood plains; slopes are 0 to 2 percent. The native vegetation is hardwood forest. The surface layer is silt loam and has moderate organic matter content (2.0 to 4.0 percent). Permeability is moderate (0.6 to 2 in/hr) in the most restrictive layer above 60 inches. Available water capacity is high (11.6 inches in the upper 60 inches). The pH of the surface layer in non- limed areas is 6.0 to 7.3. Wetness and flooding hazard are management concerns for crop production. This soil responds well to tile drainage; it is designated not highly erodible (class 3) in the Highly Erodible Land (HEL) classification system. Because of the flooding hazard, this soil has a severe limitation for most non-ag uses. Additional information about soils is available in the "Soil Survey of Hamilton County". The engineer and/or developer should consider the need for an onsite soils investigation. I have reviewed the plans for this project and have the following comments: · This project exceeds the threshold for Rule 5 projects and must be designed to meet those requirements. See www.hamiltonswcd.org for information about the revised rule. Consider sheet flow instead of th e 12" RCP that drains the north end of the parking lot directly to the creek. · Improvements to the detention basin should be included for better water quality. · Basements are not recommended in these soil types. We offer the following comments: GENERAL INFORMATION 1. The project site is located within current City of Carmel Corporate Limits. 2. Jurisdictions: · Street and Right of Way - City of Carmel (Guilford Road, Main S.treet). · Water - City of Carmel · Sanitary Sewer- City of Carmel · Storm Sewer - City of Carmel 3. Board of Public Works and Safety Approval Requkements: · Water and Sanitary Sewer Availability. · Commercial Curb Cut. The request for Board approval should include 8 ½" x 11" exhibits that will indicate the proposed curb cuts and all appropriate data and dimensions including width, radii, etc. Please indicate all existing and opposing driveways and their relationship to the proposed curb cuts for this development. · Temporary Construction Entrance. Separate BPWS approval will be required if this entrance is to be located anywhere other the site of the permanent curb cuts. · Consent to Encroach approvals for any permanent improvement to be installed within dedicated easements and/or dedicated right of way. If an irrigation system is planned for this project, additional Water Availability approval will be required from the Board and additional Water Connection Fees will be due. · Dedication of Right of Way. Preferred dedication forms are available electronically from this office. I am enclosing copies of the form for your use. Water and Sanitary Sewer Availability and Connection Fees: Water and Sanitary Sewer Availability (acreage) Fees - It is our assumption that this site and previous development was served by and connected to Carmel Utilities. Water and Sanitary Sewer Connection Fees - In order to calculate Connection Fees for this development, detailed usage information is required. If a restaurant is to be included, we will need the total number of seats planned. Restaurants are calculated at 0.10 EDUs per seat. If office or retail, we will need the total square footage for each. Offices are calculated at 0.50 EDUs per 1000 square feet and retail is 1.00 EDUs per 1000 square feet. We do not have a classification for an automotive service and repair business. Please provide proposed usage for this facility. Please specify what type of residential units are planned for the upper level and number of bedrooms for each unit. Connection Fees are $1,310.00 per EDU for water and $795.00 per EDU for sanitary sewer. I am enclosing Average User Factor Sheets for water and for sanitary sewers. ; TAC Review/Drawings submitted for approval: We request that all comments and comment letters generated by this office be answered in writing and be accompanied by a drawing reflecting requested revisions. Final drawings will not be approved for construction until all issues have been resolved. All Carmel Utility issues must also re resolved. The design engineer must certify all drawings submitted for final approval. This office will require a minimum of five-sets (maximum of seven-sets) of approved drawings after all issues have been resolved. The drawings will be stamped approved and signed by both the City Engineer and Director Carmel Utilities. The Developer/Owner will receive one-set which is to be maintained on the construction site at all times. Carmel Utilities will receive two-sets. Our Public Works Inspector will receive one-set and one-set will be maintained in the Department of Engineering. If more than the minimum of five-sets are requested to be approved, the additional sets (maximum total of two additional) must be submitted with the five required sets. Please be advised that any installation of signs, walls, irrigation systems, etc. within dedicated easements and/or right of way will require Consent to Encroach approval. Carmel Utilities does not subscribe to "Holey Moley" and should be contacted directly for all water and sanitary sewer main locations. Carmel Utilities will provide a separate review of this project for water and sanitary sewer issues. The 20-Year Thoroughfare Plan designation for this portion of Main Street is a Secondary Parkway with a right of way requirement of 120-feet total, 60-feet half. The Alternative Transportation Plan (ATP) calls for 1 O-foot wide, separated, parallel multi-use paths for this portion ot' Main Street. We will yield to the Department of Community Services to determine the requirements for this development. · What is the purpose of the circular sidewalk at the intersection? It is labeled as a handicap ramp. · The sidewalk in the right of way serving the entry/exit from the building at the intersection appears to be curbed. It this the intent of the double lines? Are these walks to be privately maintained? 14. Grading & Erosion Control Plan-Sheet C202 · Please place flow arrows in the parking areas to indicate how this site will discharge surface storm water run-off. 15. Utility Plan-Sheet C203 · Carmel Utilities normally requires the sanitary lateral outlet from a commercial/retail development to discharge directly to a sanitary manhole.
