WARRANTY DEED
THIS INDENTURE WITNESSETH THAT Michael R. Griswold and Elizabeth M. Griswold, husband
and wife. (individually and collectively the "Grantor convey and warrant to the City of Carmel, Indiana the
"Grantee for the sum of Seventeen Thousand Eight Hundred and 00 /100 Dollars ($17,800.00) and other
valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the following described
real estate in Hamilton County, State of Indiana:
See attached Exhibit A, which is attached hereto and incorporated herein
subject to any and all easements, agreements, restrictions and other matters of record.
It is understood between the parties hereto, and their successors in title, and made a covenant herein which shall
run with the land, that all real estate herein described (excepting any parcels or portions thereof that are
specifically and expressly designated as easements or temporary rights of way) are conveyed in fee simple and
not merely for right of way purposes, and that no reversionary rights whatsoever are intended to remain in the
Grantor.
IN WITNESS HEREOF, Grantor has caused this Warranty Deed to be executed this 1 day of

Owner: Michael R. Griswold and Elizabeth M. Griswold
The negotiation section has pursued the attempted acquisition of the above subject parcel to the point where
we are at a complete impasse with the owner in regards to the amount of just compensation.
The City's "Fair Market Value” determination is $13,100.00.
The owner has agreed to settle for $17,800.00 and will accept nothing less.
We feel that it would be to the City's best interest to settle for the requested amount in Tight of the costs
involved in litigation and the risk of an even more generous court award.
We, therefore, recommend that the sum of $17,800.00 be awarded to the owner, this is an increase of
$4,700.00 over the original offer and represents the most practical and economical solution to this case.
Reason given by owner for the increase is: Additional replacement of fencing not included in the appraisal
and the take will cause a modification of cattle handlin to barn.
