ONE CIVIC SQUARE CARMEL, IN 46032 Representing the Committee: Ephraim Wilfong, Acting Chairperson; John Adams;, Judy Hagan, Steve Lawson Representing the Department: Adrienne Keeling; Alexia Donahue -Wold, Mike Hollibaugh; Lisa Stewart, Recording Secretary Of Counsel: John Molitor The Subdivision Committee will meet to consider the following items: Docket No. 11080011 Z: Monon Overlay Rezone, Natural Section North. The applicant seeks approval to rezone properties which abut the Monon Greenway north of First Street NW, to include them in the Monon Greenway Overlay Zone. This overlay district is super imposed over the primary zoning districts, and its regulations shall supersede those of the primary zoning districts. The properties which are included in the rezone consist of properties which abut the Monon Greenway from 146 Street to First Street NW. Filed by the Carmel Dept. of Community Services on behalf of the Carmel Plan Commission. 2. Docket No. 11080013 OA: Monon Overlay Ordinance Amendment. The applicant seeks approval to amend Chapter 23H: Monon Greenway Overlay Zone of the Zoning Ordinance in order to modify the regulations as need be during the rezoning of the affected parcels in the Natural Section North. Filed by the Carmel Dept. of Community Services on behalf of the Carmel Plan Commission. Adrienne Keeling presented for the Department. Will keep discussion on both items together, She reviewed the previous meeting. There is now a surveyed center line along the entire length of the trail so we are proposing the boundary line of the overlay zone be 90 ft. on either side of the center line. Committee We discussed showing a measurement from the center line versus the property line. The measurement distance was kept from the property line, since every other measurement is from the property line. A measurement from the center line measurement can be put in parenthesis if that would be helpful. Reordering the language of the exceptions that were proposed existing subdivisions and PUD's it was suggested to make these more prominent in the beginning of the Setback Section. So it is clear to those reading it that existing lots, PUD's and subdivision can just more forward with the regulations that are already in place for them. We removed restrictions on accessory buildings and sheds and added a single set back distance for new development which we have proposed at 55 ft. from the property line or 88 ft. from the center line. Also discussed making the conflicts from the other Overlay Zones clear i.e., all the other Overlay Zones supersede in conflicts except the Monon Greenway Setback would override all others., Adrienne reviewed her handout with the Committee. The 33 ft. is definitely measured from the centerline. Please keep in mind that the center line that is painted on the trail may or may not be the actual surveyed center line. John Molitor indicated that the zoning map controls. We need to be specific because although the Committee realizes that the zoning map controls, citizens may not. We can prepare an exhibit that would show what the zoning map would look like with the 90 ft. overlaid upon it. Yes it would be helpful as an exhibit. The conflicts on page 2 overlays shall govern Adrienne reviewed changes in handout Zone 9 south and west of Meridian and Monon Discussion on what this means how this interpretation would work. And how it applies it is in addition to whatever your overlay already indicates Page 3 section added for front setbacks not abutting the Monon Greenway they rely on their primary zoning Bottom of page reordered Ephraim, when someone want to build a house on a property do they have to do a primary or secondary plat? Or do they just get a building permit and if needed go through the TAC process. If the lot is already subdivided then they just need to get a building permit. If they are in Old Towne they may need to get design review for the new structure. If this is to prevent overly large structures from the Monon we need to identify areas along with Monon where building could occur that would fall under the new Ordinance. If a natural disaster occurred and someone bought the property and did not build a single family home, but rather purchased the lot next door and changed the use of the property it would trigger the new ordinance. However, if a new owner simply rebuilds a home no trigger would occur. Need some way to protect single family structures in the future without every triggering a setback requirement. The principal is what is it going to be used for a family home, housing a family unit and that is all that is all that is occurring on these combined properties, so if there is a way to protect that without triggering the setbacks that would be the best solution Page 2 of 1 ONE CIVIC SQUARE CARNIEL, INDIANA 46032 317 571 -2417 Sept. 6, 2011 Meeting Agenda Carmel Plan Commission Subd. Committee If we had a provision that stated if you aggregating lots your limit is no more primary dwelling units than the number of lots that you are aggregating, but if you are subdividing we are going to prevent that. If someone is just rebuilding a primary residence we do not want to encumber them The problem occurs if you are increasing the number of units, even if you are the same property owner, ie you want to make a rental property. We are drawing the line they become a developer at that time. Lengthy discussion on what the process is for increasing the number of buildings on a piece of property Variance can always be applied for. You cannot take away the right of someone to apply for a variance but the variance is not always granted. New principal bldg. 88 ft. from center line Further discussion regarding side yard/front yard/side setback Other amendments have been discussed regarding landscaping, parking, etc. triggered when there is a Plan Commission Review.
