Illinois Street Improvement Fund #212ORDINANCE 2086 -12 SPONSOR(s): Councilor(s) Rider, Schleif Seidensticker, Sharp and Snyder AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, ADOPTING AND ADDING CARMEL CITY CODE CHAPTER 2, ARTICLE 4, SECTION 2-141, ESTABLISHING A NON REVERTING ILLINOIS STREET IMPROVEMENT FUND #212 WHEREAS, the City desires to make improvements to Illinois Street to alleviate traffic congestion during the accelerated construction of the US 31 improvements; and WHEREAS, extension and improvements to Illinois Street will enhance the economic vitality of the area bordering Illinois Street; and WHEREAS, it will be necessary and in the public interest for the City to make significant design and construction improvements to the extension of Illinois Street; and WHEREAS, the establishment of a Non Reverting Illinois Street Improvement Fund is necessary for the acceptance of any transfer or appropriated dollars into Fund #212 including surplus bond funds and other legal sources of revenue prior to the initiation of any bid or commencement of construction for any capital project. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, as follows: Section 1: The foregoing Recitals are fully incorporated herein by this reference. Section 2: That Chapter 2, Article 4, of the Carmel City Code is hereby amended to add a new Section 141 which shall read as follows: "Sect. 2 -141. Non Reverting Illinois Street Improvement Fund #212 (a) There is established a Non- Reverting Illinois Street Improvement Fund #212 to be used exclusively for the purpose of accepting and disbursing monies consistent with the plans for Illinois Street construction as approved by the Common Council and the Mayor. (b) The Non Reverting Illinois Street Improvement Fund shall be managed by the fiscal officer of the City as required by law. (c) The monies contained in the Non Reverting Illinois Street Improvement Fund shall be accounted for and maintained separate and apart from all other City funds, and shall be invested with the interest earned. (d) The Funds held and accounted for in the Non Reverting Illinois Street Improvement Fund shall be expended only: 1. Solely and exclusively for the purpose of completing the improvements to Illinois Street; 2. The Common Council shall approve all engineering estimates, construction plans and rights -of -way costs. After approval by the Common Council, the Department of 1 Engineering may commence the bid process and construction of improvements to Illinois Street in accordance with all established procedures. Section 3. That the remaining provisions of Carmel City Code Chapter 2, Article 4, are not affected by this Ordinance and remain in full force and effect. Section 4. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect. Section 5. This Ordinance shall be in full force and effect from and after its passage and signing by the Mayor and such publication as is required by law. k.
