SEWER AND WATER LINE EASEMENT
THIS INDENTURE WITNESSETH THAT American Aggregate Corporation, hereinafter
called GRANTOR, for and in consideration of the sum of One Dollar ($1.00) paid
to Grantor, the receipt of which is hereby acknowledged, does hereby grant and
convey unto The Town of Carmel of Hamilton County, Indiana, hereinafter called
GRANTEE, an easement and right -of -way to construct, operate, control, maintain,
and remove the following utility lines, to -wit:

(a) Water Mains
(b) Sewer Lines
over, along and across the following described real estate in Hamilton County,
Indiana, to -wit:
The Northwest Quarter of Section 33, Township 18 North, Range 4 East;
in Hamilton County; in the State of Indiana, more particularly des-
cribed as follows:
Beginning at the Northwest Corner of said Section and proceeding east
along the North line of said Section a distance of 1560 feet; thence
South along a line parallel to the West line of said Section a dis-
tance of 40 feet; thence West along a line parallel to the north line
of said Section a distance of 1560 feet to a point on the South line
of said Section; thence North along the South line of said Section
a distance of 40 feet to the point of beginning, containing in all
1.47 acres, more or less. Subject to any legal easements.
The GRANTEE agrees to indemnify and hold harmless GRANTOR from and against all
claims, demands, actions or causes of action which may hereafter be asserted
against GRANTOR by any person or persons arising out of or by reason of damage
or personal injury or death arising out of or resulting from the installation,
construction, operation and maintenance of said water and sewer lines, and
GRANTEE does further agree that any and all sums of money due or claimed to be
due in connection with such installation will be paid and /or indemnified
against by GRANTEE.
GRANTEE hereby agrees that upon completion of the installations authorized
by the terms of this agreement, that the GRANTEE will restore the areas of land
involved as near as possible to the original condition of same.

GRANTOR shall not place anything over or so close to said sewer and water
pipe line or other facility of GRANTEE located within said right -of -way as will
be likely to interfere with GRANTEE'S access thereto by means of equipment
customarily employed in the maintenance of said sewer and water pipe line.
The undersigned persons in executing this sewer and water line easement on
and in behalf of the GRANTOR represent and certify that they are duly elected
officers of the GRANTOR and have been fully empowered by proper resolution of
the Board of Directors of the GRANTOR, to execute and deliver this sewer and
water line easement; the GRANTOR has full corporate capacity to convey the real
estate described herein; and that all necessary corporate action for the making
of such conveyance has been taken and done.
IN'WITNESS WHEREOF, the GRANTOR has caused this sewer and water line ease-
ment to be executed this 5th day of April 1974.
