Q-9) AGREEMENT FOR UTILITY AVAILABILITY AND CONNECTION FEES IN LIEU OF PAYMENT FOR EASEMENT WHEREAS, Bambie Burgess and September Shull are the Grantors of a certain easement to the City of Carmel, Indiana, of a fifteen foot strip on the southside of lots 5 and 6 in the Thornhurst Addition, which is more particularly described as follows: A strip of land fifteen feet wide running the length of lots 5 and 6 on their southside in Christie's Thornhurst Addition, first sec- tion, amended, in Plat Book 2, Pages 59 and 60 in the Office of the Recorder of Hamilton County, Indiana. AND WHEREAS, the City of Carmel, Indiana and its Utility provide water to their customers, for an availablity and connection fee; and WHEREAS, the parties hereto are mutually agreeable to enter into an agreement providing an easement for a waiver of certain availabi- lity and connection fees; NOW, THEREFORE, BE IT AGREED BY THE PARTIES AS FOLLOWS: 1. That Bambio Burgess and September Shull hereby agree to grant a General Easement for Utilities, Sidewalk, and Streets, for the City of Carmel and the City of Carmel Utilities of a strip of land fifteen feet wide along the southsides of lots 5 and 6 as described above. 2. That the City of Carmel and the Carmel Utilities agree to provide water access to the Grantors, and in consideration for the grant of easement, and waive any and all availability and connection fees to the aforementioned lots 5 and 6.
