hereinafter called "Grantors" for and in consideration of the
sum of ONE DOLLAR ($1.00), and other valuable consideration,
the receipt of which is hereby acknowledged, do hereby GRANT,
QUITCLAIM and CONVEY unto the CITY OF CARMEL, INDIANA, herein-
after called "City a utility easement and right of way to
lay, maintain, repair, replace, alter or inspect a storm sewer,
together with the granted right to operate the same on, along,
in, upon or across the following described real estate in
Hamilton County, Clay Township, Indiana, to -wit:
A strip of land 10 feet in width by parallel lines,.
to be reserved as an easement for storm sewer and
utility purposes, off the South side of the East
130 feet of a parcel of real estate located in
part of the Northeast Quarter of Section 25, Town-
ship 18 North, Range 3 East in Hamilton County,
Indiana described as follows:
Beginning at the Northeast corner of said Quarter
Section run West twelve (12) rods, ten (10) feet,
south eight (8) rods, seven (7) feet, six (6) inches,
thence east twelve (12) rods, ten (10) feet thence
north eight (8) rods, seven (7) feet, six (6)
inches, to the place of beginning. ti

At any time it should become necessary for grantee to
excavate to reach a utility line, the City or it's agents
shall back fill and restore said surface area to the condition
equal to that existing prior to such excavation. A maximum
effort shall be made to avoid damage to any trees or plants
within the easements, but the City shall not be liable for
such damage. While the City or it's agents are on Grantor's
property, the City agrees to protect and hold Grantor harmless
for all personal injury claims sustained or claimed to have

been sustained by any person or persons whomsoever in connection
with such entry while on the property of the Grantors.
In the event this property is developed, and it would b.e advantag-
ous to the owner to relocate a certain existing storm sewer line
located wholly. thereon;
the City agrees to pay one half of the cost to relocate the existing
storm sewer line which presently runs from a point about 3ft North
of the South property line, and located about 125 feet West of the
East property line, thence North westerly, to an existing catch
basin at the edge of 8th Street N.W. This relocation would consist
of installing 15 inch concrete pipe from the above beginning point,
West parallel to: the South property line to a point due South of the
catch basin on 8th Street N.W. and then North to the catch basin on
8th Street.
