QUITCLAIM AND GRANT UNTO THE TOWN OF CARMEL, INDIANA, AS
A UTILITY EASEMENT, THE REAL ESTATE HEREINAFTER DESCRIBED
TO BE USED AS HEREINAFTER MORE SPECIFICALLY SET FORTH:

IT IS THE INTENTION OF THE ABOVE DESCRIPTION TO
DELINEATE A 20 -FOOT STRIP ALL THE WAY ACROSS THE
OWNER'S PROPERTY, AND THE EXTERIOR LIMITS OF THIS
STRIP MAY BE LENGTHENED OR SHORTENED TO COINCIDE
WITH THE PERIMETER PROPERTY LINES OF THE OWNER'S
PROPERTY.
(1) SAID EASEMENT IS TO BE USED R Y THE TOWN OF
CARMEL FOR THE INSTALLATION AND MAINTENANCE OF A SANITARY
SEWER TRANSMISSION LINE. IO PERMANENT STRUCTURE SHALL BE
ERECTED ON SAID STRIP, SUBSEQUENT OWNERS SHALL TAKE THEIR
TITLE SUBJECT TO THE RIGHTS OF THE TOWN OF CARMEL FOR
INGRESS AND EGRESS IN, OP:, A_L01'1(- AND ACROSS THE ABOVE.

DESCRIBED EASEMENT AND THE TOWN OF' CARMEL WILL HOLD
HARMLESS THE OWNERS OF SAID LAND AGAINST ANY AND ALL
CLAIMS FOR INJURY TO PERSON OR PROPERTY RESULTING FROM OR
CLAIMED TO HAVE RESULTED FROM THE PRESENCE OF ANY EMPLOYEE
OR AGENT OF THE TOWN OF CARMEL WHILE SAID PERSONS ARE
WITHIN SAID EASEMENT AND ON OFFICIAL BUSINESS FOR THE TOWN
OF CARMEL
(2) THE TOWN AGREES TO RESTORE GROUND SURFACE
BASICALLY TO ITS ORIGINAL CONDITION. THE TOWN AGREES TO
MAKE A MAXIMUM EFFORT TO AVOID DISTURBANCE TO ANY TREES
DURING CONSTRUCTION.
IN WITNESS WHEREOF THE UNDERSIGNED, AS OWNERS OF
THE ABOVE DESCRIBED REAL ESTATE, HAS SET THEIR HAND AND
SEAL THIS 73 DAY OF SEPTEMBER, 1972.
