Dixie Highway Addition, lot 2 (pt) - Yang Health Center
The applicant seeks to rezone approximately 0.2 acres from R-3/Residence to B-1
Business. The site is located at 10640 N College Ave and is within the Home Place
Business District Overlay.

The Department recommends that the agenda be reordered for item number 2i to be heard at the
same time as this item. Item 2i is a DP/ADLS companion to this item.
The applicant is requesting a favorable recommendation from the Plan Commission to rezone the
subject property from the existing R-3 / Residential classification to B-1 / Business and approval
of a DP/ADLS application to construct a building addition and new parking area. Please see the
information packet for an overview of the proposal. The subject property is within the Home
Place Business District Overlay. This area is planned for future commercial uses under the
Carmel/Clay Comprehensive Plan. The proposed B-1 zoning complies with the range of uses
and standards contemplated within the Comprehensive Plan and overlay zone ordinance. The
Department recommends that the Commission forward the rezone request to the City Council
with a favorable recommendation once review of the DP/ADLS is complete.
This item is back on the Plan Commission agenda under public hearings due to a notice error last
month. However, no public comments were heard at the meeting last month and the Committee
did discuss this item at the June 1 st meeting date. The committee voted

final action on this item as well as the DP/ADLS at the conclusion of the public hearing.
The Department recommends that the Plan Commission forward this request to the City
Council with a favorable recommendation.
Background:
Prior to the adoption of the Home Place Overlay a Use Variance was approved by the Board of
Zoning Appeals to allow a general office to be operated from the site. Last year the County
acquired right-of-way from the owner for the construction of the 106th Street and College Avenue
intersection improvements. The acquisition of additional right-of-way took several of the
parking spaces on the site and requires the demolition of an existing accessory building on the
property as well. At this time the owner would like to add on the existing building in addition to
addressing the parking needs brought on by the loss of real estate for the road project.

The applicant seeks approval of a building addition. The site is located at 10640 N
College Ave and is within the Home Place Business District Overlay.

The Special Studies Committee forwards a favorable recommendation to the full Plan
Commission on this request. Please see the revised informational packet distributed with the
agenda for this meeting. Changes were made to the color of exterior materials and design of the
east fagade of the building. These changes addressed all department concerns.
The Department recommends that the Plan Commission approve the Development Plan as
amended subject to adoption of the rezone proposal by the City Council.
Additional Note: Written findings are required for action on the Development Plan. The
applicant shall present these to the Commission at the meeting prior to approval.
