The site is located southeast of 97th Street & Michigan Rd. The site is zoned B-2/Business and S-I/Residence within the US 421 Overlay Zone. Filed by Chris McComas of Advocati, LLC. The public hearing for this item was held on September 21. It was tabled prior to the October meeting, and forwarded at the November 4th committee meeting to the full Plan Commission with a favorable recommendation. At the Plan Commission meeting on November 16th an individual from the public spoke indicating that they were an adjacent owner and had concerns about the proposal. After much discussion the Commission decided to send the item back to the Special Studies Committee allowing the committee to take final action on the item. The Department recommends that the Committee forward docket No. 04030048 Z to the City Council with a favorable recommendation. The Department recommends that the Committee approve the proposed DP/ADLS subject to the following: 1. Dedication of fight-of-way as depicted on the site plan. Background: The applicant is requesting approval of a Development Plan and ADLS for the redevelopment of the property located at the northeast comer of 96t" Street and Michigan Road. Please see the informational packet prepared by the applicant for an overview of the site and building elevations. In addition to the DP/ADLS approval the applicant is requesting favorable consideration of a rezone from S-1 Residence to B-2/Business of a lot adjacent to the existing site to allow expanding of the development and to be in closer compliance with the 3 acre minimum area required by the US 421 Overlay.
