Docket Nos. 04030047 DP/ADLS and 04030048 Z: North Augusta,-Sec 1, lots 10pt-ll and Sec 2, Lot 39: My Three Sons Ventures, LLC The applicant proposes a retail building development and rezoning lot 39 from S- 1/Residence to Business. The site is located southeast of 97th Street & Michigan Rd. The site is zoned B-2/Business and S-l/Residence within the US 421 Overlay Zone. Filed by Chris McComas of Advocati, LLC. The Committee forwards these items back to the full Plan Commission with 3-0 favorable recommendations. Updated information was distributed with the agenda last week. The Department recommends that the Plan Commission forward docket No. 04030048 Z to the City Council with a favorable recommendation. The Department recommends that the Plan Commission approve the proposed DP/ADLS subject to the following: Dedication of right-of-way as depicted on the site plan. Background: The applicant is requesting approval of a Development Plan and ADLS for the redevelopment of the property located at the northeast corner of 96 Street and Mxch~gan Road. Please see the informational packet prepared by the applicant for an overview of the site and building elevations. In addition to the DP/ADLS approval the applicant is requesting favorable consideration of a rezone from S-1 Residence to B-2/Business of a lot adjacent to the existing site to allow expanding of the development and to be in closer compliance with the 3 acre minimum area required by the US 421 Overlay. Several variance requests will need to be approved to allow the redevelopment as proposed. While the variances will require action by the BZA the Plan Commission should become familiar with the nature of the requests as they relate to compliance with the US 421 overlay Requirements. The Department has met with the applicant to discuss the proposed variances needed form ordinance requirements and feel comfortable in supporting the level of relief necessary to see the site redeveloped.
