The applicant proposes a retail building development and rezoning lot 39 from S-
1/Residence to Business. The site is located southeast of 97th Street & Michigan Rd.
The site is zoned B-2/Business and S-I/Residence within the US 421 Overlay Zone.

The applicant is requesting approval of a Development Plan and ADLS for the redevelopment of
the property located at the northeast comer of 96th Street and Michigan Road. Please see the
informational packet prepared by the applicant for an overview of the site and building
elevations.
In addition to the DP/ADLS approval the applicant is requesting favorable consideration of a
rezone from S-1 Residence to B-2/Business of a lot adjacent to the existing site to allow
expanding of the development and to be in closer compliance with the 3 acre minimum area
required by the US 421 Overlay.
Several variance requests will need to be approved to allow the redevelopment as proposed.
While the variances will require action by the BZA the Plan Commission should become familiar
with the nature of the requests as they relate to compliance with the US 421 overlay
Requirements. The Department has met with the applicant to discuss the proposed variances
needed form ordinance requirements and feel comfortable in supporting the level of relief
necessary to see the site redeveloped.
This item was presented at the April TAC meeting. No outstanding issues remain. The
following items are those that require additional discussion:
1. The number of signs proposed by the applicant is in excess of that permitted under the
ordinance. Greater detail needs to be submitted with regard to the proposed sign colors
and style. The applicant should propose a consistent sign program that will not detract
form the building facades.
2. Information needs to be submitted regarding the proposed ground sign.
The Department recommends that this item be forwarded to the Special Studies Committee
on October 5th for further discussion.
