This letter is confirm the City of Carmel Department of Community Services support for the
removal of this median. We have reviewed your traffic plan and consulted with the county
engineer and feel that the removal of this traffic control measure will improve safety at this
intersection. We also understand that as part of this proposal that will convert the existing curb
cut at 96 Street to right in only access to this site.

I reside on lot 38, directly cast of the proposed project, and would apprecia~ it if the
committee considers my comm~flts and concerns regarding this project, since it directly

family proposing the retail development reportmt that they had purchased my property,
which is unuu¢.
My first concern involves the distance from my home to the proposed project.
Even though them will ~y be thirty fc~'t from thc edge of my property to the
pmlmSed si~e, my home ~ is only 115 and a half feet from this boundary, which I
feel is an insufficient distance for a buffer zone. This is even more of a concern since
l've been told that Pyramid Oil Lube will be the closest cnlity to my property. This will
create noise, traffic, and possible hazard waste issues. Tracks loading and unloading in
the middle of the night will also create additional noise problems for the area residents.
Acx~ding to the plans traffic will also be rouiod through the area next to my property
which creates a safety issue and traffic flow problems, since Unffic will b~ dumped onto
9~ street Traffic is already a concern for those who live in the neighborhood and we
will soon have to deal with the Duke projects, the widening of Michigan Road, and other
construction projects in the ares. We have had to deal with the Majestic Plaza
consWuction, which is taking over five years to complete. Safety is certainly an issue,
since there are elderly and children, incl~ my dmighter, who live on 97~ street.
Another issne I have is with the existi/lg fence thai Phil Lande says will be
moved over to provide a boundary between my prope~ and the project It is, quite
frankly, old and trashy in ~, and I believe, inm~cient in providing privacy for
my home. Oiv~n the size and heil~t of the project there needs to be a hill, possibly a
taller fence, and/or trees to give my family adequate privacy.
Another concern that I have is the current businesses that occupy the present strip
mall, which includes Tasty' s i.e. porn, and a hydroponics indoor l~ud¢~ store. I'm not
crazy about having the,s~ c-stabli~~ next door to me, and worry about the types of
businesses that might be r~ntin~ ~ space in the future.
Still another concern I have is the way the demolition of the existing structures
and the consmiction will be done. Back in January the trees on the pr~ nuxt door
were cut down and two of them we-re dropped on my property. This came on the day I
r~'mmed Imme fi'om the hospital after bilatmal hip replacement surgery. Ther~ was no
follow through to clean up the mess until I threatened legal action. Still nobody came to
do the job until after four months (and actually after my daughter and myself got grext of
waiting and cleaned it up). I also had vehicles driving through my yard as if no property
eyCVm cxistexL In addition, the property ~xt to me went from being a nice home to an
eyesore. Unfommately, some of the 97~ street propmties bought by developers are

beco~ eyesores, and one has to wonder if this is a strategy designed to lower property
values and/or scare people into selling.
I'm also bothered by th~ la~k of communication I have mc,~wi about what is
going on w/th the project. I have received one l~mr about thc timc of thc first zoning
meeting, and um~liable information from thc prospcctivc buyer, but nothing else.
I recognize tht my ncighborhood is in transifi~ and that it will soon be
convcrtcd to commcrcisl projccts.! olfly ask that the zooin~o commission force those who
are developing ia the area tr~ the residents with dignity and respect, and make sure that
thc demolition of existin8 slructures, and construction of new ones, be done in a way that
does not inte~ere with our livelihood. ! personally feel that the area would benefit from
s project that was greater in scope so fl~U ~ those who have to live here do not have to
endure the constaut upheaval m~d slow destmcti(m of thc ncighborh~ in which we live.

My engineer has jury duty next week so we will need to meet without him. I am open any of the
dates you selected, which one is best for you? My problem is that the project will die if the closure
of the 96th street entry is required and if the present building sets on proposed ROW my client will
want to be compensated for its demolition as it can not be rebuilt with the present required 15'0"
setback. Also, it is funny and I do mean funny in a light hearted way...The county wants to close
the 96th street entry and the City DOC wants to close the Michigan road entry. I look forward to
setting down with you and review the situation.

Chris,
I think the biggest issue is the required right-of-way along 96th Street and the entrance
along that street. Additional right-of-way has to be dedicated with the Development Plan
per the thoroughfare plan (my understanding from the county that it is a 85' half). That
may impact the existing building. Also, for the drive to remain open and to allow the right
in / right out along US 421 we need to see a median installed on 96th street that prevents
west bound traffic from entering site.

Dear Mr. McComas:
This letter serves to acknowledge receipt of a transmittal received 4/12/04 containing the
plans for the above-mentioned project. After reviewing the plans the Highway
Department has the following comments:
1. In accordance with the Hamilton County Thoroughfare Plan, additional right of way is
required at the intersection of 96th Street and US 421. On US 421, the right of way
from the intersection to a point 500' to the north is a 75' half. From that point to the
northern property line the right of way is 65'. On 96th Street, the right of way from the
intersection to a point 500' to the east is an 85' half. From that point to the eastern
property line the right of way is a 75' half. A 50' triangular cut is also needed at the
intersection, connecting the right of way for the perimeter streets. I have included a
copy of the dedication of right of way form for your use.
2. On 97th Street, a 25' half right of way is required. A 50' triangular cut is also needed
at the intersection, connecting the right of way for the perimeter streets.
3. Due to traffic congestion, lack of offset distance and safety, the entrance on 96th
Street will not be permitted.
4. The entrance on US 421 must be approved by INDOT.
5. The curb radius at the entrance must have a minimum radius of 50". Please verify
the radius and label it on the plan sheets. The minimum offset distance of 150' for
the western drive on 97th Street is not met. The entrance must be relocated or
removed.
6. 97th Street will need to be widened to 12' for the eastbound lane. The widening must
consist of a 9" stone base, 3" HAC binder and 1" HAC surface. The eastbound lane
of 97th Street must also be curbed with a 2' chair back curb. A pavement section and
the HCHD Standard Drawing C-4 must be included in the details.
7. Please note that decorative signs, sprinkler systems, trees, landscaping mounds,
fences, light poles or other such amenities are not permitted in the right of way.
8. The ADA sidewalk ramp detail should be replaced with the appropriate INDOT
approved ramp.
9. Please note that further comments may be necessary when the construction plans
are submitted.

We have reviewed the construction plans submitted to the Hamilton County Surveyor's
Office on April 12, 2004, 2004 for this project and have the following comments:
I. The proposed project falls in the jurisdiction of Hamilton County.
2. The proposed project DOES NOT fall in a Carmel Wellhead Protection Zone.
Hamilton County Ordinance 4-26-99-C(7)b requires all sites to have storm water
staged detention for the 2-10 and I 0-100 year storm events. The proposed site
does not appear to have any on-site detention and is discharging into the U,S. 421
storm water system.

Please provid.e this office with drainage calculations (detaining to the required
standard), rewsed plans showing storm water detention facilities, and a letter from
INDOT that they are acceptable with this project proposal.

Hamilton County Surveyor's Office will not approve the proposed construction
until storm water detention is provided and we are sure INDOT is acceptable with
this design and the use of their drainage facilities.
