The applicant seeks the following development standards variance approval for a carport:
Docket No. 12020001 V ZO Chptr. 23D.03.C.3 setback
The site is located at 440 1 st Ave NE. It is zoned R4/Residence, within the Old Town Overlay
Character Subarea. Filed by Carmel Dept. of Community Services (DOCS), for Richard Habegger of
Melray Properties, LLC.
Action:
The Hearing Officer forwarded this item to the regular BZA meeting on Monday, March 26,
2012, at 6:00 pm.

The applicant seeks the following development standards variance approval:

6 -7. (V) 497 Wetherby Lake Dr. Pool Setbacks.
The applicant seeks the following development standards variance approvals for a pool/deck:
Docket No. 12010003 V Ordinance Ch. 25.01.0l.C.8.a.i: pool side yard setback.
Docket No. 12020005 V Ordinance Ch. 25.01.0l.C.8.a.iii: pool setback from an easement.
The site is located at 497 Wetherby Lake Drive. It is zoned S- 1/ROSO and not located within any
overlay zone. The minimum side yard setback for the pool/deck is 10 feet; the petitioner requests 7
feet. The minimum setback from an easement for a pool /deck is 3 feet; the petitioner requests the deck
encroach into the drainage /utility easement by 3.5 feet. Filed by Steven K. Broadwater, owner.

Discussion:

Permit process will address drainage

Neighboring lot has large mound with no retention of water
45 degree slope off back into pond
6 drain tiles on neighboring lots
9 Will work with Engineering Department for Board of Public Works approval

Lake Drive pool setbacks for pool side yard setback and pool setback from an easement with the
Conditions grade cannot change and approval of the Carmel Board of Public Works and Safety.
8. (V) Longridge Estates, Section 1, Lot 52 Construction Trailer.
The applicant seeks the following development standards variance approval:

Construction Trailer for time limit of temporary use with the Condition the three year approval is
for the construction trailer only; any storage trailers would require additional approvals.
