UTILITY LINE EASEMENT. TO TOWN OF CARM IND.
THIS INDENTURE WITNESS�,TH: That
hereinafter called "Grantors for and in consideration of the sum of
ONE DOLLAR ($1 .00), the receipt of which is hereby acknowledged, do
hereby GRANT, QUITCLALM AND CONVEY unto the TOWN OF CARMEL,
IiNDIANA, hereinafter called "Grantee an easement and right of way
with the right to lay, maintain, repair, make alteration, inspect and
replace utility lines for electric transmission and distribution, either
above or below ground surface, together with necessary 'appurtenances
or attachments or incidental equipment thereon, across, on and along
the following described real property located in Hamilton County, Clay
Township, Indiana, to -wit: c'
6' by parallel lines off the entire east side of Lot 129
in Woodland Springs Subdivision 2d Section as per plat
thereof recorded in Book 3, pages 28 and 29 in the
office of the Recorder of Hamilton County, Indiana.
It is understood and agreed, as a part of the consideration for this easement,
that the Town of Carmel or its agents shall, when necessary, have access
to said right of way and lines thereon for purposes of maintaining said lines
or equipment and the Town of Carmel shall hold grantors or their assigns
harmless from any and all claims for personal injury in connection with or
arising out of the presence of such agents while on grantors' property and
shall further be responsible for all damage to property that may be done to
said property.
