I have enclosed the public notice documentation required for our May 18, 2004 public
hearing before the Plan Commission for the Kite Companies' Medical Office Project. Included
are the Petitioner's Affidavit of Public Hearing, the certified list of adjacent property owners
from the Hamilton County Auditor's Office, the Public Notice, Proof of Publication from The
Indianapolis Star, and the white receipts and green cards from the certified mail delivery.

Construction/Stormwater Pollution Prevention Plan - Technical Review and Comment
A18 A narrative that provides a description of the soil, its limitations that effect this site and how you plan to overcome
these limitations is needed.
B 1 and B 13- Other pollutants that should be included- soil, paint and solvents, trash and concrete washout. If you are
requiring all fueling and parked vehicles to be done on pavement then you need to show the pavement on the plan and
insert the practice into the construction sequence.
B2 is a bit generic. Step #1- is there any existing inlets to protect? Step #2 The contractor will need to stock pile the
topsoil before he can bury it. Why not utilize the good top soil on the pond banks where vegetation is hard to establish.
Step#3 1 believe the staging area needs to be installed after the topsoil is stripped. The building construction starts almost
immediately. Include a note to direct the contractor to fine grade and seed the offsite swale immediately after it is
constructed.
B6 A detail for storm inlet protection is needed.
B 10- The swale is only temporary and should not be considered a long term practice for post construction water quality.
C3 1 don't believe sweeping will address the oils and other petroleum fuels mentioned in C 1. These pollutants will flow
into the storm sewer and into the basin. How effective is the basin for removing pollutants?
C5- If the basin is a major storm water practice then management plan is needed for it. A herbicide and fertility plan for
the grass areas would also be important to minimize additional pollutants from the grass areas.
The shallow nature of the north end of the pond would lend itself to a wetland system.

This permit is required for any work in the dedicated fight-of-way of streets within the City of
Carmel jurisdiction. If the work involves open cutting of a road surface, curb, or asphalt path; or
road or lane closures or traffic impediments; approval must be obtained from the City of Carmel
Board of l'ublic Works and Safety prior to obtaining a permit. There is currently no fee for the
permit. However, a Street Cut Bond is required to be posted with the permit. The bond is a
License and Permit type bond that may be obtained through your insurance provider. The City of
Carmel does not provide a standard bond form. The basis for the bond amount is $2,000.00 per
instance in the right-of-way, If the cut or work in the right-of-way is parallel to the street or right-
of-way, the bond amount shall be at a rate of' $20.00 per linear foot with a minimum requirement
of $2,000.00. The bond shall have an expiration date of not less than one year from the effective
date of thc bond,

We have received the plans for this project which is scheduled for the April 21, 2004 Technical Advisory Committee
meeting. We offer the following comments:
GENERAL INFORMATION
1. The project site is located within current City of Carmel Corporate Limits.
2. Jurisdictions:
· Street and Right of Way-City of Carmel (126th Street and Pennsylvania Street).
· Water- Indianapolis Water Company Service Area
· Sanitary Sewer- City of Carmel
· Storm Sewer - City of Carmel
3. Board of Public Works and Safety Approval Requirements:
· Sanitary Sewer Availability.
· Commercial Curb Cut. The request for Board approval should include 8 ½" x 11" exhibits that will indicate
the proposed curb cut(s) and all appropriate data and dimensions including width, radii, etc. The drawing
should also show left turn to left turn alignment with existing opposing curb cuts.
· Right of Way Dedication.
· Consent to Encroach approvals for any permanent improvement to be installed within dedicated easements
and/or dedicated right of way including irrigation systems.
I am enclosing a schedule for Board of Public Works and Safety meeting dates and agenda deadlines for your use.
Please use the Engineering Department deadlines for submissions to the Board.
Any submission to the Board requires prior final approval by the Carmel Clay Platt Commission attd/or the
Board of Zoning Appeals attd completion of review by the Technical Advisory Committee. All written requests

5. TAC Review/Drawings submitted for approval:
We request that all comments and comment letters generated by this office be answered in writing and be
accompanied by a drawing reflecting requested revisions. Final drawings will not be approved for
construction until all issues have been resolved. All Carmel Utility issues must also re resolved. The design
engineer must certify all drawings submitted for final approval. This office will require a minimum of four-sets
(maximum of six-sets) of approved drawings after all issues have been resolved. The drawings will be stamped
approved and signed by both the City Engineer and Director Carmel Utilities. The Developer/Owner will receive
one-set which is to be maintained on the construction site at all times. Carmel Utilities will receive one-set. Our
Construction Manager (Inspector) will receive one-set and one-set will be maintained in the Department o

Engineering. If more than the minimum of four-sets are requested to be approved, the additional sets (maximum
total of two additional) must be submitted with the four required sets.
6. Please be advised that any installation of signs, walls, irrigation systems, etc. within dedicated easements and/or
right of way will require Consent to Encroach approval.
7. Carmel Utilities does not subscribe to "Holey Moley" and should be contacted directly for all sanitary sewer main
locations.
8. Carmel Utilities will provide a separate review of this project for sanitary sewer issues. Please assure that Carmel
Utilities receives copies of the construction plans including all revised plans.
9. I am including copies of the following with this correspondence:

· Permit Data, Contacts, etc.
· Commercial Permitting Procedures.
BONDING REQUIREMENTS
10. Upon initial review, it appears the following bonding requirements may apply to this project:
Performance/Maintenance Guarantees
A Performance Guarantee will be required for the sidewalks in the Pennsylvania Street right of way. We requir~e a
Certified Engineer's Estimate for 100% of labor and materials required for the construction. The Performance
Guarantee amount is based upon the Engineer's Estimate. When the construction has been completed and the
Performance Guarantee has been released, a 3-year, 10% Maintenance Guarantee will be required.
Street Cut/Right of Way Permit and Bonding Requirements
Any work in the dedicated right of way of Pennsylvania Street and/or Carmel Drive will require a Right of Way
Permit and a License and Permit Bond. The bond amount will be determined by the number of instances of work
in the right of way ~ $2,000.00 per instance. Open pavement cuts in dedicated streets require approval by our
Board of Public Works and Safety. Please contact our Right of Way Manager/Inspector, Fred Glaser, to arrange
permitting and bonding.
PROJECT COMMENTS-CONSTRUCTION PLANS
11. We have engaged the services of Crossroad Engineers, PC to provide storm drainage review. The drainage
calculations have been forwarded to Crossroad. We will provide their review as soon as it is available.
12. Please advise the Owner and Contractors involved in this project that the City of Carmel has a strict ordinance
regarding mud and other substances deposited on City streets by vehicles and equipment used in excavation,
construction, demolition or otherwise within the City Limits. Be prepared to clean Pennsylvania Street during the
duration of this project.
13. Sheet C 100-Existing Conditions Map
· Label and dimension the Pennsylvania Street right of way line (existing' and proposed if different).
· Provide a legal description of the 7.92 acres.
· How can the owner remove existing trees outside of the property line? Who owns those trees?
14. Sheet C200-Site Plan · What is the estimated construction phasing for the entire development and how many phases do you
anticipate?
· It would be helpful if the adjoining development to the north and the development(s) across Pennsylvania
Street could be identified on all the sheets.
· Indicate the bottom elevation of Pond B. This pond will be constructed with this phase?
· It appears the entire site will have a total of 4-curb cuts? While this number does not appear to be out of line
with the size of the overall development, we would request that the locations be re-evaluated in regard to
existing and opposing curb cuts and the possible alignment with same.
· Is the northernmost curb cut intended to be a right in, right out? If so, the angles and radius need to be more
severe to discourage left hand tums into and out of the development at this location.
· The median needs to be constructed outside of the right of way.
· If there is to be a concrete sidewalk in the right of way of Pennsylvania Street, it must be 5-feet wide. Our
Alternative Transportation Plan (ATP) designates 1 O-foot wide separated parallel multi-use paths for this
section of Pennsylvania Street. However, we will defer to our Department of Community Services for this
determination.

· Show the connection of the sidewalk for this development with the existing sidewalk, if any, on the adjacent
north development.
· The City Engineer and/or our Department of Community Services may have additional comments regarding
any required/requested road improvements for Pennsylvania Street with this phase. This could include, but
not limited to, acceleration/deceleration lanes, etc. Additional road improvements may require Performance
Guarantees beyond what has been indicated previously.
15. Sheet C300-GradingPlan
· What is the ultimate outlet and route'for the emergency overflow should it ever be utilized? Does it access a
ditch in the U.S. 31 right of way?
· Please show flow arrows for surface drainage in the parking areas.
16. Sheet C301-Offsite Grading/Drainage Plan
· Does the property crossed by the temporary swale belong to the owner or will an easement be required?
17. Sheet C400-Utility Plan
· Is it a correct assumption that the storm drainage system will be a private system maintained by the
owner/developer?
18. Sheet C600-Details _,
· Need to include a Right of Way Pavement Section for the portion of the proposed entry pavement in
dedicated right of way. The pavement section should conform to the requirements for Pennsylvania Street.
· There is an Asphalt Walk Pavement Section. Where does this apply? Our specification for asphalt paths in
dedicated right of way is 1-inch surface, 2-inches binder and 5-inches stone.
We reserve the right to provide additional comments upon further review by the City Engineer and receipt of the storm
drainage plan review by Crossroad Engineers.
The above comments are based upon the Engineering Department's initial review. Please provide our office with a
follow up letter regarding this review and revised plans, indicating all revisions. A second review will focus only on
detailed construction plans. It is critical that our office be made aware of all modifications made on the plans being re-
submitted, particularly if any such changes are considered "new"
