HomeMy WebLinkAboutPursel Lane - Pursel, Edward/Rosalea Exclusive Utility/Platinum Properties 20030002526 11 4,I Filed for Record in HAMILTON UY DIANA JENNIFER J CO HAYNTDEN IN F_ASEMENTS EXCLUSIVE UTILITY EASEMENT THIS INDENTURE WITNESSETH, that Edward Leon Rosalea Pursel (hereinafter called "Grantor being the fee simple owner of the real estate described herein, does hereby grant and convey to Platinum Properties, LLC and the City of Carmel, Indiana (hereinafter called "Grantee a perpetual exclusive utility easement, as described on Exhibit A attached hereto and incorporated herein, for the purpose of constructing, erecting, operating and maintaining sanitary sewer facilities and if needed, water main facilities (hereinafter called "Facilities necessary for the performance of public utility function or services, subject to restrictions and conditions contained herein. 1. Grantee shall level plus reasonably compact the ground and reseed any areas that might be disturbed as a result of the construction of the Facilities, or as a result of any repairs that may be made to the Facilities thereafter. It is further required that any damage to any public and /or private drive, pipe, tile, fences, utilities, landscaping or other property of the Grantor (or successors or assigns of Grantor) caused by the installation, repair, maintenance, operation and /or removal of the Facilities shall be repaired by the Grantee in as good or better condition as the same existed, prior to said action by Grantee. 2. Grantor shall have the right to fully use and enjoy the land granted as this exclusive utility easement herein except for such use as may unreasonably impair, impede or interfere with the exercise by Grantee of the rights granted herein. The Grantor shall not construct or permit to be constructed any house, structure or obstruction on or over or interfering with the constniction, maintenance, or operation of the Facilities constructed pursuant to this instrument. 4. The grant of this easement is subject to all existing easements and rights -of- way of record. 5. The easement and covenants set forth herein shall inure to the benefit of Grantee, its successors and assigns, and be binding upon and shall inure to the benefit of the Grantor and each successor and /or assign thereof.
