Dear Mr. McBride'
As part of the development and construction of Block 11 of the Carmel Science and
Technology Park, located at the southwest corner of Carmel Drive and Guilford Road,
the Carmel Department of Engineering has requested REI Real Estate Services, LLC
("REI") donate, at no expense incurred to the City of Carmel, certain real estate
necessary for the road and intersection improvements at Carmel Drive and Guilford
Road, Ploase allow this letter to serve as our promise to donate an additional ten (10)
feet of land along the south side of Carmel Drive from Guilford Road to the western
edge of the existing pond and ten (10) feet of land approximately two hundred (200) f~et
along the west side of Guilford Road from Carmel Drive. As a part of the road and
intersection improvements and in exchange for REI's donations of real estate, we
understand that the City of Carmel will be installing sidewalks or walking paths along
Carmel Ddve and Guilford Road. The City of Carmel will also support the approval of
the encroachment of the existing sign at tl~e intersection identifying the Meridian
Technology Center within the new right-of-way as long as the sign does not pose a sight
problem for traffic turning southbound on Guilford Road.
Once the r)evelopment Plan for Block 11 is approved by the Carmel Plan Commission
that includes a "rigl]t-in/right-out" access along 122n~ Street and a cul de sac street from
Carmol Drive, REI will process the necessary right of way dedication and acceptance
for tt~o real estate with the Carmel Board of Public Works and Safety.

The developer has requested that the previous lot 3 be broken into 2 lots. As a result, we have
revised the lot numbering and the previous lot 2 is now lot 5.
1. The appropriate right of way dimensions have been provided.
2. The appropriate right of way dimensions have been provided.
3. The back of curb to back of curb width of the cul-de-sac has been appropriately labeled
as 100'.
4. Appropriate building setback lines have been provided.

9. The developer will provide appropriate agency correspondences.

10. The developer is requesting that the pond not been included in the Secondary Plat.
11. In cooperation with the Department of Engineering, a 5-ft concrete sidewalk has been
provided along the Carmel Drive frontage connecting to the sidewalk proposed as part of
the Carmel Drive improvement plans and extending approximately 45' east of Carmel
Drive Court's eastern right of way line extended.
12. A 5-ft wide sidewalk has been added along the entire Carmel Drive Court right of way as
requested.
13. Due to the uncertainty of the future property owners and uses, the locations of building
footprints have not been determined and therefore, cannot be shown on the plans.
14. No landscaping has been proposed for the development infrastructure. Appropriate
landscape plans will be developed and provide for each of the lots as they are
developed, such as are now proposed for Lot 4, the Companion Animal Hospital.
15. The Urban Forester's Approval will be forwarded when obtained. It is our understanding
that he is in agreement with the plan as proposed but we will request a confirming letter.

requested. The location has been shifted west which will require agreement from
the adjacent property owner, which the developer is in the process of gaining. It
is our understanding that the City wishes to construct the portion within As there
are no current development plan associated with this entrance, we intend to
construct the actual connection at the time the lot is developed.
A 5-ft wide sidewalk has been added along the entire Carmel Drive Court
frontage. -

5. An outlet permit for the discharge into the WR Fertig Regulated Drain and a Non
Enforcement for Individual tracts for the roadway encroachment across the existing WR
Fertig Regulated Drain have been submitted.

In cooperation with your office, it has been determined that the western boundary Of the
Regulated Drain Easement containing the pond shall be 16' off the proposed eastern
property line of Lot 4 and extend northward until intersecting with the proposed Right of
Way of Carmel Drive Court. This matches the centerline of the un-named easement
shown on the original plat. The Construction Plans now appropriately incorporate this
easement.

In cooperation with the City of Carmel, it has been determined that the location of
Carmel Drive Court's intersection with Carmel Drive as shown is the best location. It is
located approximately half way between the existing intersections of 122n~ Street and
Guilford Drive. In addition, the City's road improvement plans in this area indicate a
concrete median along this sites western most frontage of Carmel Drive. Moving the
street location west would limit vehicles ability to make left turns from Carmel Drive
Court onto Carmel Drive. Therefore, we request that the Hamilton County Standard be

We have reviewed the drawings submitted for this project for the April 21, 2004 Technical Advisory Committee
meeting. We offer the following comments:
GENERAL INFORMATION
1. The project site in the Carmel Science and Technology Park is currently located within current City of Carmel
Corporate Limits. The following jurisdictions will apply.
2. Jurisdictions:
· Street and Right of Way-City of Carmel (Carmel Drive/122nd Street)
· Water-Project is within Indianapolis Water Company service area.
· Sanitary Sewer-Project is within Clay Township Regional Waste District.service area.
· Storm Sewer - City of Carmel. Hamilton County Surveyor's Office regarding discharge to the WR Fertig
legal drain.
3. Board of Public Works and Safety Approval Requirements:
· Consent to Encroach Agreements for any permanent improvement to be installed within dedicated right of
way and/or dedicated easements.
· Secondary Plat approval.
I am enclosing a schedule for Board of Public Works and Safety meeting dates and agenda deadlines for your use.
Please use the Engineering Department deadlines for submissions to the Board.
Any submission to the Board requires prior final approval by the Carmel Clay Plan Commission and/or the
Board of Zoning Appeals and completion of review by the Technical Advisory Committee. All written requests
to be place on the Board's agenda must inchtde the appropriate Docket Numbers and the date (or dates) of
approval by the Platt Commission attd/or BZA.
4. TAC Review/Drawings submitted for approval:
We request that all comments and comment letters generated by this office be answered in writing and be
accompanied by a drawing reflecting requested revisions. Final drawings will not be approved for construction _
until all issues have been resolved. The design engineer must certify all drawings submitted for final approval.
This office will require a minimum of three-sets of approved drawings
after all issues have been resolved and the construction drawings have been approved. The drawings will be
stamped approved and signed by the City Engineer. The Developer/Owner will receive one-set
which is to be maintained on the construction site at all times. Our Public Works Inspector will receive one-set
and one-set will be maintained in the Department of Engineering. If more than the minimum three-sets are
requested to be approved, the additional sets (maximum total of two additional) must be submitted with the three
required sets.
5. Please be advised that any installation of signs, walls, irrigation systems, etc. within dedicated right of way and/or
dedicated easements will require a Consent to Encroach Agreement between the Owner/Developer and the City of
Carmel. This Agreement requires Board of Public Works and Safety approval.

BONDING REQUIREMENTS
7. Upon initial review, it appears the following bonding requirements may apply to this project:

Please provide individual, detailed certified Engineers Estimates for 100% of the cost of labor and materials for
the above improvement. Post a Performance Guarantees in the amount of the Engineer's Estimates. Three-year
Maintenance Guarantees will be required upon release of the Performance Guarantee.
Street Cut/Right of Way Permit and Bonding Requirements
Any work in the dedicated right of way of Carmel Drive not included or covered by a Performance Guarantee v~ill
require a Right of Way Permit and a License and Permit Bond. The bond amount will be determined by the
number of instances of work in the right of way ~ $2,000.00 per instance. Open pavement cuts in dedicated

may apply to the contractor and his subs, this would not apply to the City of Carmel and we therefore require
that you remove it from the plans.

except this is a commercial subdivision. The sidewalks would be bonded with the street project and
constructed as each individual lot develops.
· Please label any portion of the west right of way line of Guilford Road appearing on this or any sheet as stich.
· Why aren't curb underdrains indicated on the plans?
· Change metal end section to concrete.
· It appears that this project needs to be coordinated with the City's City Center Drive project which could
commence in late May, early June.

· Provide bollards or other means of protection along the existing lake frontage. The installation should not be
within dedicated right of way.

· It appears that in order to make the tap on the north side of existing Carmel Drive, an open pavement cut will
be required. As stated previously in these comments, Board of Public Works and Safety approval is required
for all open cuts in dedicated streets.

13. C803 - General Details · Move sub surface drain under the curb.
· Change type of inlet to Type "M" (INDOT) or equal to prevent structure from extending under the roadbed.
· Change 3" of #9 Binder toS" of 5D Base.

· Place a notation with the Pavement Section to read, "All Paving is to be Completed in One Paving Season."
PROJECT COMMENTS-SECONDARY PLAT
1. Does this plat reflect the right of way requirements for the City Center Drive road improvement project?
2. Both Carmel Drive and 122nd Street are indicated as 70' R/W. Believe that is the existing total R/W and what
is shown on the plans is a 35' half R/W.
3. What are the two City of Carmel exceptions noted on the plans?
4. Believe that concrete monuments will be required at all perimeter boundaries. We will defer to the
Department of Community Services.
5. If the eastern boundary (S00°I 8'08"E/78.01) at the southeast comer of the plat is a right of way line for
Guilford Road, please label as such.

The above comments are based upon the Engineering Department's initial review. We reserve the right to provide
additional comments as this project proceeds through the approval process and after we have reviewed the drainage
calculations provided. Please provide our office with a follow up letter regarding this review and revised plans,
indicating all revisions. A second review will focus only on detailed construction plans. It is critical that our office be
made aware of all modifications made on the plans being re-submitted, particularly if any such changes are considered

Blk 11, lots 2-4. This is a preliminary letter to let you begin on revisions. Members at the TAC Meeting will make
additional comments on April 21. Please complete the following items after you have received additional comments at the
TAC Meeting.

1. Please show/label the 45-ft half fight-of-way for Carmel Drive.
2. Please show/label the 70-ft half fight-of-way for 122nd Street.
3. Please show the cul-de-sac diameter as required by the Carmel Engineering Dept.

We have reviewed the construction plans and plat submitted to the Hamilton County
Surveyor's Office on April 5, 2004 for this project and have the following comments'
1. This project falls within the jurisdiction of the City of Carmel.
2. This proposed project does NOT fall in a Carmel Watershed Protection Area.
3. Please coordinate the storm sewer design with both the City of Carmel
Engineering Department and this office.
4. This proposed project falls in the W.R. Fertig Drainage Shed.
5. Please submit an outlet permit, for the discharge into the W.R. Fertig Regulated
Drain, to this office. Please submit a Non Enforcement Request for Individual
Tracts for the roadway encroachment across the existing W.tL Fertig Regulated
Drain. The applications are available on our website at

6. The pond directly to the east of this proposed project is part of the W.R. Fertig
Regulated Drain and it protected .from filling or altering the of the storage volume.

Hamilton County Recorders Office an existing drainage easement is shown for
the entire corner plus 7.5 feet each way of a platted easement line. This is not
shown on the plat and is shown in the construction plans but is not acknowledged.

On April 2, 2004, I filed with the City of Cannel Department of Community Services,
on behalf of REI Investments, Inc., Development Plan and Secondary Plat applications and
corresponding plans for the remaining real estate within Block 11 not developed by the
Companion Animal Hospital at the southwest comer of Carmel Drive and Guilford Road, in
Carmel, Indiana. Enclosed herewith are the site construction drawings, including the plat, for
your review.
We anticipate having this project placed on the April 21, 2004 agenda of the Carmel
Technical Advisory Committee and the agenda of the Carmel/Clay Plan Commission for
