EASEMENT ENCROACHMENT AUTHORIZATION
The undersigned is .a duly authorized agent of the
Town of Carmel, who possesses a utility
and drainage easement across the rear of the following
described real estate:
Lot #129 in Brookshire, Second Section,
in Hamilton County, Indiana, as per plat
thereof, recorded in Plat Book 3, page 116,
in the office of the Recorder of Hamilton
County.
Commonly known as: 12008 Brookshire Parkway,
Carmel, Indiana
There is a concrete swimming pool deck and fence
situated on the above described property which encroaches
upon the utility and drainage easement to the extent of
1.25 feet, as indicated in a survey plat prepared by
Weihe Engineers, Inc.
Permission is hereby granted to the present and
subsequent owners, their heirs and assigns allowing the
above encroachment to exist; provided that the easement
holder shall have no liability for the future removal or
damage to the encroaching structure resulting from
proper utilization of the easement.
