KNOW ALL MEN BY THESE PRESENTS, that Lumber Mart, Inc., a
corporation organized and existing under the laws of the State of
Indiana, hereinafter referred to as "Grantor in consideration of
One dollar 1 •00 the receipt of which is
hereby acknowledged, does hereby grant to the Board of Trustees of
the Town of Carmel, Indiana, and their successors in office, herein
after referred to as "Grantee a temporary easement for a period
equal to the period of construction of a public road with Grantee
having the right to use that portion of real property hereinafter
described in whatever way and manner needed to construct a public
road, such easement to be over the following described premises in
the County of Hamilton, State of Indiana, to -wit:
A part of Lot 26 in Glenwood Subdivision, a subdivision
in the Northeast Quarter of the Northeast Quarter of
Section 7, Township 17 North, Range 4 East, the plat of
which is recorded in Plat Book 3, page 45, in the Office
of the Recorder of Hamilton County, Indiana, described as
follows: Beginning at the northwest corner of said lot;`
thence South 89 degrees 44 minutes 00 seconds East 103.92
feet along the north line of said lot; thence South 0
degrees 16 minutes 00 seconds West 15.00 feet; thence
North 89 degrees 44 minutes 00 seconds West 103.92 feet
to the west line of said lot; thence North 0 degrees 17
minutes 00 seconds East 15.00 feet along said west line
to the point of beginning and containing 1,559 square
feet, more or less.
Grantor shall not hinder in any way Grantee's rights of ingres-
and egress over the aforestated real property nor in any way hinder
or restrict the use of said real property by Grantee for the pur-
poses aforementioned. This Instrument Recorded 19 7

Grantee will repair and restore the aforemenioned premises to
a condition equal to that condition of said premises prior to the
granting of this easement over those premises described hereinabove
at the expense of Grantee.
The undersigned persons executing this temporary easement for
the construction of a public road on behalf of Grantor represent

and certify that they are the duly elected officers of Grantor and
have been empowered by proper resolution of the Board of Directors
of Grantor to execute and deliver this right of way grant as to the
real property described herein; that all necessary corporate action
for the making of such conveyance has been taken and done.
IN WITNESS WHEREOF, Grantor by its officer have hereunto set
their hands and seals on this 5 day of May, 1974.
