OF HAMILTON COUNTY, INDIANA, DOES HEREBY DEDICATE, QUIT—
CLAIM AND GRANT UNTO THE TOWN OF CARMEL, INDIANA, AS A
UTILITY EASEMENT, THE REAL ESTATE HEREINAFTER DESCRIBED
TO BE USED AS HEREINAFTER MORE SPECIFICALLY SET FORTH:

ESTATES, EIGHTH SECTION, A SUBDIVISION
RECORDED IN THE OFFICE OF THE HAMILTON
COUNTY RECORDER IN PLAT BOOK 3, PAGE 117,
MORE PARTICULARLY DESCRIBED AS FOLLOWS:
A 20 —FOOT STRIP OF GROUND LYING 10 FEET
ON EITHER SIDE OF THE FOLLOWING DESCRIBED
CENTERLINE:
COMMENCING AT THE EASTERLY CORNER OF THE
AFOREMENTIONED LOT N0. 177; THENCE SOUTH
71 WEST, ALONG THE SOUTHEASTERLY
LINE THEREOF, A DISTANCE OF 120.809 FEET
TO THE POINT OF BEGINNING OF SAID CENTER
LINE; THENCE NORTH 46'50'16" WEST A DIS—
TANCE OF 147. 756 FEET TO A POINT ON THE
NORTHWESTERLY LINE OF THE AFOREMENTIONED
LOT N0. 177, SAID POINT BEING THE TERMINUS
OF SAID CENTERLINE.
IT IS THE INTENTION OF THE ABOVE DESCRIPTION
TO DELINEATE A 20 —FOOT STRIP ALL THE WAY
ACROSS LOT N0. 177, AND THE EXTERIOR LIMITS
OF THIS STRIP MAY BE LENGTHENED OR SHORTENED
TO COINCIDE WITH THE PERIMETER PROPERTY
LINES OF LOT NO. 177.

(1) SAID EASEMENT IS TO BE USED BY THE TOWN OF
CARMEL FOR THE INSTALLATION AND MAINTENANCE OF A
SANITARY SEWER TRANSMISSION LINE. NO PERMANENT
STRUCTURE SHALL BE ERECTED ON SAID STRIP, SUBSEQUENT
OWNERS SHALL TAKE THEIR TITLE SUBJECT TO THE RIGHTS OF
THE TOWN OF CARMEL FOR INGRESS AND EGRESS IN, ON, ALONG
AND ACROSS THE ABOVE DESCRIBED EASEMENT AND THE TOWN OF
CARMEL WILL HOLD HARMLESS THE OWNERS OF SAID LAND
AGAINST ANY AND ALL CLAIMS FOR INJURY TO PERSON OR
PROPERTY RESULTING FROM OR CLAIMED TO HAVE RESULTED FROM

THE PRESENCE OF ANY EMPLOYEE OR AGENT OF THE TOWN OF
CARMEL WHILE SAID PERSONS ARE WITHIN SAID EASEMENT AND
ON OFFICIAL BUSINESS FOR THE TOWN OF CARMEL.
(2) THE TOWN AGREES TO RESTORE GROUND SURFACE TO
ITS ORIGINAL CONDITION. THE TOWN AGREES TO MAKE MAXIMUM
EFFORT TO A VOID DISTURBANCE TO ANY TREES DURING CONSTRUCTION.
