HomeMy WebLinkAboutMedical Drive - S&CHW Investments 8600830 11 5 6CQK 3 PAGE 3 SANITARY SEWER EASEMENT AGREEMENT g y This Agreement made this day of 1986, by and between S CHW Investment Company Owner and the City of Carmel "City WITNESSETH: WHEREAS, S CHW Investment Company is the Owner of a strip of ground twenty -five (25) feet in width by parallel lines to be used as an easement for a sanitary sewer located in a part of the Southwest Quarter of Section 31, Township 18 North, Range 4 East of the Second Principal Meridian in Hamilton County, Indiana, the Southerly line of said easement being as follows: Commencing at the Southwest corner of said Southwest Quarter; thence North 89° 50' 15" East along the South line of said Southwest Quarter a distance of 733.00 feet; thence North 00° 24' 05" East a distance of 660.00 feet to the Southerly right -of -way line of Carmel Medical Drive, the right -of -way dedication of which is recorded in Miscellaneous Record 159, pages 493 -497 and Miscellaneous Record 159, page 558 in the Office of the Recorder of said County; thence North 76° 56' 20" East along said South right -of -way line a distance of 518.05 feet; thence North 13° 03' 40" West, 50.00 feet to the Northerly right -of -way line of said roadway, being the Point of Beginning of this easement; thence North 76° 56' 20" East, along said right -of -way line 165.77 feet to the termination point of this easement; contains 0.095 acre, more or less. Subject to highways, rights -of -way and easements. WHEREAS, Owner is willing to create an easement to City, its successors and assigns, to use the above described strip of ground for the purpose of maintaining and repairing the sanitary sewer. NOW, THEREFORE, Owner grants an easement in the above described strip of ground to City, its successors and assigns, to use the strip of ground to maintain and repair the sanitary sewer across, through and under the strip of ground above described. It is understood that the employees of City, its successors and assigns shall, when necessary, have access to the described easement for the purposes of maintenance and repairs, provided City, its successors and assigns shall be responsible for any damage that may be done to the above described property of Owner. It is further understood that City shall return the above described property to its original condition after performing any maintenance or reapirs to the sanitary sewer line.
