WHEREAS, ST. MARK'S UNITED METHODIST CHURCH of Carmel,
Indiana, hereinafter referred to as "Grantor" is the owner
of a certain tract of land in Hamilton County, Indiana, more
particularly described as follows:
Part of the Southeast Quarter of the Southeast Quarter
of Section 29, Twp. 18 North, Range 4 East in Hamilton
County, Indiana more particularly described as follows:
Beginning at the Southeast Corner of the Southeast
Quarter, Section 29, Twp. 18 North, Range 4 East,
thence North 89 deg. 21 min. 20 sec. (assumed bearing)
on and along the South Line of said quarter section,
590.00' to a point, thence North 00 deg. 38 min. 40
sec. East 492.007' to a point, thence North 56 deg. 24
min. 22 sec. East, 110.962' to a point, thence North 90
deg. 00 min. 00 sec. East, 492.005' to a point, thence
South 00 deg. 00 min. 00 sec. East, on and along the
East Line of said Quarter, 560.007' to the point of
beginning of this description, containing 7.435 acres
more or less.

WHEREAS, the CITY OF CARMEL, hereinafter referred to
as "Grantee" has requested an easement for the purpose of
installation and maintenance of utilities along the west and
north boundaries of the above described tract of land, and
WHEREAS, Grantor has no objections to the granting of
said utility easement.
For the sum of One Dollar ($1.00) and other valuable
consideration, in receipt of said consideration acknowledged
by signatures affixed hereto, Grantor now grants to Grantee
an easement in perpetuity for the purpose of installation,
utilization, and maintaining of certain utilities over the
following described parcel of real estate:
A 10 foot easement, the centerline of which is
described as follows:
Commencing at the Southeast Corner of the Southeast
Quarter of Section 29, twp. 18 North, Range 4 East,
Hamilton County, Indiana, thence North 89 deg. 21 min.
20 sec. West (assumed bearing) on and along the South
Line of said Quarter Section, 590.00' to a point,
thence North 00 deg. 38 min. 40 sec. East, 40' to a
point, thence South 89 deg. 21 min. 20 sec. East, 5.00'
to the beginning point of this description, said point
being the centerline of said 10' easement, thence North
00 deg. 38 min. 40 sec. East, 455.354' to a point,
thence North 56 deg. 24 min. 22 sec. East, 95.872' to a
point, thence North 90 deg. 00 min. 00 sec. East,
459.532' to the West Right of way line of Gray Road,
said point being the end of said easement.

That maintenance of the above described easement shall be
the responsibility of Grantor except in the event of
utilization of the easement by Grantee and Grantee or his
assigns, they shall be responsible for restoring the
property to its original condition upon utilization of same.

ACCEPTANCE OF EASEMENT
Comes now the undersigned Board of Public Works and hereby
accept the easement heretofore conveyed to the City of Carmel on
or about November 4, 1985, and further hereby accepts the terms
and conditions of said easement.
