Charles E. Walter and Alberta Walter I
.hereinafter called "Grantors for and in consideration of the
sum of ONE DOLLAR ($1.00), the receipt of which is hereby acknowledged,
.do hereby GRANT, QUITCLAIM and CONVEY unto the TOWN OF CARMEL, INDIANA,
hereinafter called "Town",
a utility easement and right of way to flay,
maintain, repair, replace, alter or inspect utility lines for the
transmission and distribution of municipal utilities, together with the
granted right to operate the same on, along, in, upon or across the
following described real estate in Hamilton County, Clay Township,,
Indiana, to -wit:
[The LEGAL DESCRIPTION of the utility easement granted AND
the Town Engineer's map thereof are attached hereto, made
j a part hereof and marked "Exhibits A and B"
At any time it should become necessary for grantee to excavate to
reach a utility line, the Town or it's agents shall back fill and

restore said surface area to the condition equal to that existing
prior to such excavation. Restoration shall include but not be i
limited to sod, grass, trees, fence.or shrubs which may be damaged
by such excavation. While the Town or it's agents are on Grantors'
property, the Town agrees to protect and hold Grantors harmless for
all personal injury claims sustained or claimed to have been sustained
by any person or persons whomsoever in connection with such entry while
on the property of the Grantors.
This utility easement shall run with the title to the land described

in Exhibits "A" and "B" above. As part of the consideration for this
easement, Grantors or their assigns shall have the right to one (1)
1 residential connection to the sanitary sewer line with tap fees or
1 other connection charges.
IN WITNESS WHEREOF Charles E. Walter and
i Alberta Walter as ,Grantors, have caused this utility
1 easement to be executed and delivered to the Town of Carmel,

Acres Re- Subdivision Easements
A permanent easement 15.0 feet wide centered on the following
described center line: A part .of Lot #1 in Charles E. Walter's Rol-
ling Acres Re- Subdivision as per plat thereof recorded November 4,
1956, in Plat Book 2, Page 79, in the Office of the Recorder, Hamilton
County, Indiana, said tract also being part of the northeast quarter
of the southeast quarter of Section 24, Township 18 North, Range 3
East, said center line described as follows, to -wit: Beginning at a
point on the north line of said Lot 41, 94.82 feet east of the north-
west corner thereof, said point being on the north line of said cruar-
ter- quarter and 270.78 feet west of the northeast corner thereof;
thence from the easterly bearing of said north line deflecting right
68 degrees 24'minutes' and running southeasterly 34.44 feet to .a point;
thence deflecting left 65 degrees 09 minutes and running southeasterly
19.9 -feet to a point on the west right of way line of U.S. 31 as per
plans :thereof dated August 15, 1960 (S- Project No. 165.(14) Sheet 424),
said -point bring the terminus of said permanent easement center line.
Also, a temporary construction easement on and across all of Lot
01 and a 25 foot wide strip of land of even width off of the northeast

side of Lot #2, all in Charles E. Walter's Rolling Acres Re- Subdivision,
as.per plat thereof recorded November 4, 1956 in Plat Book 2, Page 79,
in the-Office of the Recorder, Hamilton County, Indiana, and:being Hart
of the northeast quarter of the southeast quarter of Section 24, Tol-ln-
ship '18 North, Range 3 East.
