WATER LINE EASEMENT
THE UNDERSIGNED, Jerry 4f. York and Margaret Ann York
(hereinafter referred to as "Grantor in consideration of the
sum of One Dollar ($1.00) and other valuable consideration, the
receipt of which is hereby acknowledged, the undersigned, Jerry
H. York and Margaret Ann York hereby grant to the City of Carmel
(hereinafter referred to as "Grantee it's successors and
assigns, an easement for the installation, construction,
maintenance and repair of a water line' in, under, and upon the
real estate located in Clay Township, Hamilton County, Indiana,
and more particularly described on Exhibit A hereto.
The Grantee agrees to be responsible and pay for all damages
to Grantor's property that have been or are caused by the
construction and maintenance of said water line.
The foregoing notwithstanding, the Grantee agrees that the
existing trees, the location of which are identified on Exhibit
B, shall not be damaged or destroyed and that the stone drive as
shown on Exhibit B will immediately be returned to its original
condition on the completion of construction of the water main.
The Grantor reserves, after the installation of the water
line the full use of the land which is•not inconsistent with the
existence and maintenance of said water line.

Water Line Easement
An easement for a water line over, under and across a portion of the
North Half of the Southwest Quarter of Section 19, Township 18
North, Range 4 East in Hamilton County, Indiana, said easement being
25.00 feet in width and the Southwesterly line of said easement
being more particularly described as follows:
Commencing North 89 degrees 14 minutes 55 seconds East 1440.16 feet
East of the Northwest corner of said North Half of the Southwest
Quarter of Section 19, Township 18 North, Range 4 East at a point-on
the East right -of -way line of State Road #431 and on the North line
thereof; thence continuing North 89 degrees 14 minutes 55 seconds
East on and along the North line of said Quarter Section 1110.33
feet to a found stone; thence South 00 degrees 16 minutes 40 seconds
East. 623.00 feet to an existing iron pipe and the North right -of -way
line of the abandoned Traction Company right -of -way; thence South 65
degrees 37 minutes 15 seconds West 422.90 feet on and along the
North line of said abandoned right -of -way line to the Easterly
right -of -way •line of State Road #431 and to the place of beginning
of the Southwesterly line of said easement herein described; thence
North 50 degrees 39 minutes 55 seconds West 155.25 feet; thence
North 44 degrees 00 minutes 05 seconds West 300.00 feet to the point
of termination of the Southwesterly line of said easement. The
Northeasterly line of said easement to be lengthen to the
termination at the North right -of -way line of the abandoned traction
company rignt -of -way.'
