SANITARY SEWER EASEMENT
THIS EASEMENT, executed this 7S -7-14 day of 4-Z
1993, by DAN YOUNG CHEVROLET, INC., an Indiana corporation
"Grantor WITNESSES:
For good and valuable consideration, the receipt and
sufficiency of which are hereby acknowledged, Grantor grants,
conveys and declares a non exclusive easement for sanitary sewer
and utilities upon, over and across the real estate owned by
Grantor more particularly described in Exhibit "A" attached
hereto and by reference made a part hereof, for the benefit of
the real estate owned by C.P. Morgan Communities, L.P.
"Communities and described in Exhibit "B" attached hereto and
by reference made a part hereof.
The easement granted herein includes the right of
construction, operation, maintenance, repair and replacement.
Grantor also grants to the City of Carmel, Indiana, the right to
perform maintenance, repair and replacement of sanitary sewer and
utility material and equipment within the easement.
The easement herein granted shall be permanent, shall burden
the Real Estate, and shall be binding upon Grantor, and its
successors and assigns, and shall benefit Communities, its
successors and assigns.
Grantor's source of title is 87 -7413 and Communities sources
of title are and
